  • How to use the Records
    ** Access Conditions **

    These records have been transferred to the Public Record Office Victoria on the condition that requests for access will be referred to the Clerk of the Legislative Council/Assembly for determination in each case. Applications should be made to the above officers and written approval must be presented at the Public Record Office Victoria search rooms before the records will be made available for public inspection.

    The original papers tabled at any one session are tied together and labelled with the session number and date. They are therefore arranged chronologically. Access may be made via Hansard when reference is made to the tabling of specific papers during a particular session.

  • Function / Content
    This series comprises the original documents tabled in the Legislative Council. Original papers tabled include Reports, Petitions, Returns, Messages, Division Lists, Evidence and Estimates. These include annual reports of Departments of State or Statutory Authorities required to submit their reports under the Annual Reporting Act or the reports of other public bodies required under specific Acts to table their reports. Originals of both published and unpublished papers are included in this series.

    Other papers tabled include ministerial papers and Parliamentary Committee reports.

    Division Lists:

    These record the results of votes taken in the Council. When a question is before the chair in the Council (either on a Bill or other matter) a vote is called to decide the issue. This is called a Division in the house. Two sheets of paper record the Ayes and the Noes separately (with the names of the members and how they voted). If a matter is subsequently called into question before a Court these Divisions provide the legal authority. There can also be "Divisions in Committee of the Whole". These occur when the Council is formed into a committee in order to discuss or consider a Bill. The chairman leaves the chair and is replaced by the Chairman of Committees. When a vote is called the Ayes and Noes are recorded in the same way as above.

    Petitions:

    Petitions from the public etc. are often tabled in the Council. In order to be eligible, the petition must be addressed correctly, cannot be for money and must end in a prayer. The subject matter can vary widely but it must be within the power of the Parliament to grant the request otherwise they are not valid.

    Ministerial Papers:

    Ministers are allowed to table documents relating to any issue or subject provided they have the permission of the Council to do so.

    Committee Reports:

    Reports of Parliamentary Committees are tabled either on completion or as interim reports.

  • Recordkeeping System

    Within the P consignment papers for certain periods are located out of sequence. For the following years:

    1851-1856 see units 456-539 and 666
    1856-1956 see units 1-455
    1956-1971 see units 540-666 and 667-679
    Units 680-701 contain miscellaneous documents for the years 1856-1972.

    The P3 consignment contains Planning Scheme Amendment plans for the period 1972 to 1988. Under the provisions of the Town and Country Planning Act 1961 and the Town and Country (Amalgamation) Act 1980 these planning schemes were required to be submitted to the Governor-in-Council for approval. These plans relate to files found in the P1 and P2 consignments of the series. However as the plans were rolled-up and kept separately they have been accessioned as a separate consignment.
