Cancer Advisory Panel for Complementary and Alternative Medicine (CAPCAM)

Purpose

The Cancer Advisory Panel for Complementary and Alternative Medicine (Panel) shall advise and make recommendations to the Director, National Center for Complementary and Alternative Medicine (NCCAM), on present and future clinical trials regarding complementary and alternative medicine interventions in cancer.

Authority

42 U.S.C. 282(b)(6), section 402(b)(6) of the Public Health Service (PHS) Act, as amended. The panel is governed by the provisions of the Federal Advisory Committee Act, as amended (5 U.S.C. Appendix 2), which sets forth standards for the formation and use of advisory committees.

Function

The Panel shall advise, consult with, and make recommendations to the Director, NCCAM, regarding the review and assessment of summaries of evidence for complementary and alternative medicine cancer intervention clinical trials submitted by practitioners, to evaluate whether and how these interventions should be followed up, to develop a means of communication of the results of these studies to practitioners and when appropriate, the public, and to identify future alternative and complementary cancer clinical trials initiatives.

As necessary, the Panel and its subcommittees may call upon special consultants, assemble ad hoc working groups, and convene conferences and workshops.

Structure

The Panel shall consist of 15 members, including the Chair appointed by the Director, NIH. Of the 15 members, 11 shall be nonfederal and 4 shall be Federal members. The Director, Office of Cancer Complementary and Alternative Medicine, shall serve as a nonvoting ex officio member of the panel. At least one of the members shall be a registered nurse and one member shall represent the interests of individuals undergoing complementary and alternative medicine cancer therapies. The Chair of the Panel shall be a nonfederal member. Nonfederal members will be selected based on their knowledge and expertise in the fields of complementary and alternative therapeutic cancer treatments. Additional expertise from either the complementary and alternative medicine modalities or conventional medicine modalities will include knowledge or experience in clinical trials, biostatistics, oncology, meditation, pathology, radiology, and/or bioethics.

Federal members will serve as voting members and will be selected based on their knowledge and expertise in the identification and execution of traditional, complementary, and alternative therapeutic cancer therapies.

Members shall be invited to serve for overlapping four-year terms. Terms of more than two years are contingent upon renewal of the Panel’s Charter by appropriate action prior to its expiration. A member may serve after the expiration of the member’s term until a successor has taken office. A quorum for the conduct of business by the full committee shall consist of a majority of currently appointed members. A quorum for each subcommittee shall consist of three members.

As necessary, standing and ad hoc subcommittees, composed of members of the parent committee, may be established to perform specific functions within the Panel’s jurisdiction. The Department Committee Management Officer shall be notified upon the establishment of each standing subcommittee and shall be given information on its name, membership, function, and estimated frequency of meeting.

Upon approval by the Chair, the advice of a subcommittee shall be considered the advice of the Panel.

A member of one subcommittee may serve as a voting member of other subcommittees when that member’s expertise is required. However, that member shall not be counted in determining the presence of a quorum.

Management and support services shall be provided by the Office of the Director, NCCAM.

Meetings

Meetings of the full Panel shall be held approximately two times a year at the call of the Chair, with the advance approval of a Government official who shall also approve the agenda. A Government official shall be present at all meetings.

Meetings shall be open to the public except as determined otherwise by the Secretary of Health and Human Services. Notice of all meetings shall be given to the public.

Meetings shall be conducted and records of the proceedings kept, as required by applicable laws and Departmental policies.

Compensation

Members shall be paid at the rate of $200 per day, plus per diem and travel expenses, as authorized by section 5703, Title 5 U.S.C., for persons in the Government services employed intermittently. Members who are officers or employees of the United States Government shall not receive compensation for services on the Panel.

Annual Cost Estimate

Estimated annual cost for operating the Panel, including compensation and travel expenses for members, but excluding staff support, is $25,371. The estimate of annual person-years of staff support is 0.2 at an estimated annual cost of $22,450.

Reports

In the event a portion of a meeting is closed to the public, a report shall be prepared which shall contain, as a minimum, a list of members and their business addresses, the Panel’s functions, dates and places of meetings, and a summary of the Panel’s activities and recommendations made during the fiscal year. A copy of the report shall be provided to the Department Committee Management Officer.

Termination Date

Unless renewed by appropriate action prior to its expiration, the Charter for the Cancer Advisory Panel for Complementary and Alternative Medicine will expire on February 26, 2003.
