ILGA (the International Lesbian, Gay, Bisexual, Trans and Intersex Association) strongly believes in protecting the privacy of personal information obtained from our friends and visitors to our Web site ("End Users"). ILGA does not require that you share any personally identifiable information in order to use ILGA.org. ILGA does not collect personally identifiable information about people without their permission. The more you tell ILGA.org about you, the better we are able to customize the very interactive ILGA.org to suit your interests. Scope

This Terms and Conditions of Use agreement governs your use, actual or attempted, of ILGA.org and all content made available to you through the same by either ILGA or any third parties.

This policy constitutes the entire agreement between you and ILGA, superceding any prior or inconsitent representations or agreements regarding your use of ILGA.org.

Disclaimer of Warranty, Limitation of Liability and Release

The use of ILGA.org and the content therein is at your own risk and is provided on an “as is, as available” basis. ILGA makes no warranties or representations regarding the accuracy, reliability, security, or appropriateness of any data that ILGA or any third party may submit, publish, transmit, or represent (“post”) on ILGA.org and does not bear any liability for any direct or indirect damages that result from this agreement or the use or inability to use ILGA.org. ILGA does not endorse any opinions expressed by third parties on ILGA.org.

In the event that you have a dispute with a third party or are in any way damaged by a third party as a result of your use of ILGA.org, you hereby release ILGA and covenant not to sue, make a claim, or file any legal action against ILGA.

Indemnification

You agree to defend, indemnify, and hold ILGA harmless against any losses, including legal fees, resulting from your breach of these terms or your use of ILGA.org.

Jurisdiction

This agreement and your use of ILGA.org shall be governed by the courts of Belgium. You hereby expressly consent to the exercise of personal jurisdiction in the courts of Brussels, Belgium in connection with any dispute relating to your use of ILGA.org. If any terms of this agreement are found to be invalid by a court having jurisdiction over a dispute in connection with this agreement, the invalidity of those provisions shall in no way affect the remaining provisions.

Access and Use of ILGA.org

The information that you post on ILGA.org must be, to the best of your knowledge, accurate and complete when given to ILGA.org and shall not be knowingly misrepresented.

You may not post information on ILGA.org that is defamatory, vulgar, obscene, discriminatory, or otherwise abusive, that violates any law, or that violates the property or proprietary rights or confidentiality of others. You may not post unauthorized advertisements or solicitations of businesses, chain letters or pyramid schemes, or otherwise “spamming” content. Further, you may not distribute viruses on ILGA.org, disrupt the security of ILGA.org, harvest or gather information about others on ILGA.org without their consent, or otherwise act in a way which exposes ILGA to risk or liability.

Security

Your user ID, password, and any additional codes meant for your identification (“IDs”) are personal to you and must be kept confidential. You should not allow any other person to use your name or IDs to access or use ILGA.org. You are strictly responsible for maintaining and monitoring the confidentiality and security of your IDs and for any liabilities suffered as a result of your failure to do so. You must immediately notify ILGA if you become aware of any unauthorized use of your IDs.

ILGA retains the right, but not the responsibility to monitor posts and to remove content within our sole discretion. If you discover content that does not conform to this agreement, please email information@ilga.org.

Termination

ILGA may terminate this agreement, deactivate your account and IDs and refuse access to ILGA.org at any time without notice, with or without cause. You may also terminate this agreement and your account and IDs by providing written notice of your wish to terminate and ceasing use of ILGA.org. Termination shall be your only remedy if you are dissatisfied with ILGA.org.

Permissions

ILGA retains the right to record and archive posts. You hereby grant ILGA an unconditional license to use in any manner the content that you post on ILGA.org.

If you believe that any information on ILGA.org constitutes copyright infringement of your work, please contact ILGA at information@ilga.org. You should provide a description of the work and the license it violates, a description of where the work is located on ILGA.org and contact details, including email, where you can be reached after further investigation.

Content posted by ILGA on ILGA.org is protected under the Creative Common License which can be viewed here. This license governs all content published by ILGA on ILGA.org including, but not limited to audio, video, image, text, and interactive material. You may copy, distribute and transmit the work provided that you attribute the work to ILGA, but not in any way that suggests that ILGA endorses you or your use of the work. You may not alter, transform, or build upon this content, nor may you use any of this content for commercial purposes.

Any content posted by a third party on ILGA.org is not to be used without permission of said third party.
