Thai girl who lost case against SMRT, LTA to appeal High Court decision

A Thai teenager who lost both her legs in an accident at Ang Mo Kio MRT Station in 2011 intends to appeal a High Court decision after she recently lost a lawsuit against train operator SMRT and the Land Transport Authority (LTA).

SINGAPORE: A Thai teenager who lost both her legs in an accident at Ang Mo Kio MRT Station in 2011 intends to appeal a High Court decision after she recently lost a lawsuit against train operator SMRT and the Land Transport Authority (LTA).

Nitcharee Peneakchanasak’s lawyer, Peter Cuthbert Low, said a notice of appeal was filed in the courts on Friday.

Nitcharee had sued SMRT and the LTA for S$3.4 million, saying they had breached their duty of care in negligence, and failed to ensure the station was reasonably safe.

Her claim was dismissed with costs by the High Court earlier this month.

Nitcharee was 14 years old when she fell onto the tracks and a train ran over her legs.

The High Court found that Ang Mo Kio MRT Station was reasonably safe at the time of the incident, and the defendants were not liable.

The High Court also found that the MRT station was not congested when the incident happened, and did not require additional manpower to patrol the station at all times to avert an incident of someone falling unintentionally onto the tracks, especially if the fall was not caused by congestion.
