·        Nintendo may share your information with other entities of the Nintendo group, in particular with its branches in Italy and the United Kingdom or its European affiliates Nintendo France SARL, Nintendo Ibérica, S.A. and Nintendo Benelux B.V.; with Nintendo of America Inc., located in the United States, which adheres to the “Safe Harbour Principles” providing for a level of data protection comparable to the level of protection in the European Community, as well as with Nintendo Co. Ltd., located in Japan. 2. A Special Note for Parents

3.            Information Collected and its Uses

3.1        What Information We Collect

Registration as a member of Club Nintendo requires that you submit your date of birth, email address, country, postcode, and gender, as well as a username and password for use in Club Nintendo. You may also voluntarily provide your mobile phone number if you wish to receive newsletters via SMS or use your mobile phone to download mobile phone items from the Stars Catalogue.

If you order a physical item in the Stars Catalogue, you will be asked to provide your first and last name and your postal address in order to have the item delivered to you. This information will be deleted after you have received the item.

When you visit the Club Nintendo website, we may collect the IP address which is automatically assigned to your computer by your internet service provider. Additionally, we will store information you submit when participating in product surveys and information about the way you use our services, Club Nintendo and the Club Nintendo website, your Stars and your order history in the Stars Catalogue.

3.2        Cookies and Web Beacons

Nintendo may place cookies and web beacons on its website which may be used to collect information about the sections you visit, the products you are interested in and how you navigate the website. We may link the information collected by cookies and web beacons to the other information collected from you. This information may be used to customise the website for you, provide you with individualised information about Nintendo or third-party products and for other Marketing Purposes.

4.            User Communications

When you send an email or other communication to Nintendo, we may retain those communications in order to process your inquiries. Most communications are deleted after they are responded to. 5.            Nintendo Newsletter

If you subscribe to newsletters from Nintendo and its local affiliates, we will use your email address to send you the newsletters alerting you to new Nintendo or third-party products, features and enhancements, special offers, upgrade opportunities, contests and events of interest. 6.            Linking Your Club Nintendo Account to Your Nintendo Console

If you already own a Nintendo console or if you buy such a console in the future, you have the option to link your Club Nintendo account to your console (provided your console supports this feature).

Even though you will be able to enjoy all services and advantages of your Nintendo console without linking in this way, linking your console to a Club Nintendo account allows you to take advantage of several additional features:

·        You will be able to redeem your Stars to get points or funds for shopping services on your console (service dependent on availability)

·        You will be able to claim Stars for Virtual Console games you purchase (service dependent on availability).

·        You will be able to check your statistics from Nintendo games with online functionality (service dependent on availability).

After you link your Nintendo console to a Club Nintendo account, Nintendo may collect information about the way you use your console and the network services provided through your console, including information about the applications and channels you use, the products you are interested in, the games you download and/or play and how long you play them. Any information stored in relation to your console will be linked to the information stored in relation to your Club Nintendo account; this information may be used for Marketing Purposes.

You can unlink your Nintendo console and Club Nintendo account any time by changing the respective setting in your console or by contacting Nintendo customer service.

7.            Who Has Access to Your Information

Nintendo may share your information with other entities of the Nintendo group for Marketing Purposes, in particular, with:

·        its branches in Italy, Germany and the United Kingdom, and its European affiliates Nintendo France SARL, Nintendo Ibérica, S.A. and Nintendo Benelux B.V.;

Nintendo may also use third-party data processors acting in the interest of Nintendo to administer and process your information strictly in compliance with this Club Nintendo Privacy Policy.

8. Changes to the Club Nintendo Privacy Policy

A current version of this Club Nintendo Privacy Policy will always be available on the Club Nintendo website, identified at the top of the page by its effective date. Nintendo may change this Club Nintendo Privacy Policy at any time so far as is necessary or helpful to enhance the service or to adapt it to reflect changes in technical or legal requirements. Linking the Wii Shop Channel account to the Club Nintendo account

*Please note: The WiiConnect24 service which allows access to the Wii Network Services is not currently available in South Africa.

If you already own a Wii console or if you buy a Wii console in the future, and if you choose to take advantage of the Wii Network Services, you have the option to link your Club Nintendo account to your Wii Shop Channel account.

Nintendo does not sell personal information that we collect, but only employs that information for its own purposes and those of its branches and affiliated companies.

Provided you consent, (see below) Nintendo may share your information with other entities of the Nintendo group, in particular its branches in Italy, Germany and the United Kingdom and its European affiliates Nintendo France SARL, Nintendo Espana, S.A. and Nintendo Benelux B.V. Nintendo may also share your information with its affiliated companies Nintendo Co.,Ltd. in Japan and Nintendo of America Inc. in the U.S.

The level of data protection under the laws of Japan is lower than the level in the EU.

The reason for such transfer to affiliated companies inside and outside Europe is to enable them to inform you about their promotions and Nintendo or third party products and to conduct internal marketing studies.

Nintendo may also share your information with third party outsourced data processors acting in the interests of Nintendo and strictly in compliance with the Nintendo Privacy Statement as set forth herein.

Review and correction of information

After you provided personal information to Nintendo you can review, change or delete it by clicking here, or sending an email to nintendo@core.co.za.  A request to delete your personal information may lead to a termination of your account.

Email correspondence with Nintendo

Because an email address might contain personal identifying information, we protect the privacy of the sender by limiting access to these email messages and keeping them in a secure email system. Most email messages are deleted after they are responded to, however in certain cases, when necessary for the intended purpose, hard copies or data from certain email correspondence may be kept on file. Any such copies will also be stored in a secure location, and information from these messages will not be used for marketing purposes. In the event that Nintendo becomes legally obligated to disclose information obtained from consumers on its website pursuant to legal or administrative process, Nintendo will take all reasonable steps to remove personal information from the data where possible.

Revocation and consent process and removal from Nintendo's database

If you do not want Nintendo to use the data as outlined in this privacy policy you can revoke your consent to the use of the data any time by sending an email to nintendo@core.co.za.  In addition you can request the deletion of all or part of your personal data from our database. This may lead to a termination of your account.

Safeguarding your personally identifiable information

Nintendo will only collect personally identifiable information to the extent deemed reasonably necessary to perform the services provided through the Nintendo Website and to serve our legitimate business purposes, and Nintendo will maintain appropriate safeguards to ensure the security, integrity and privacy of the information you have provided. In addition, Nintendo will take reasonable steps to ensure that third parties to whom we transfer any data will provide sufficient protection of that personal information. (For example, if they are sending out an email announcement on Nintendo's behalf).
