“You are exactly correct the Attorney filing the case knows that he can't prove false imprisonment, but he hopes with the bad press and the poor public opinions of the banking industry, that they will get a nice settlement of which the Attorney will get 40% plus all of the expenses that he incurs. I don;t know exactly how the bank employees should have handled the evacuation, but they were probably told to evacuate immediately and orderly and there was probably only one employee that had an idea that someone was in the Safety Deposit Box room. But as you said this case will never go to court, it will either be settled or thrown out. Bank of America is owned by stockholders, many of which are union workers that have BOA in their pension plan investment, school teachers retirement funds are stock holders in BOA, as are many people that have 401K. So the settlement will only take dividends from those pension funds. Regualar people are the ones that wind up paying for all of these law suits. I do know if I were the person locked in the bank and came out and everyone was gone, I would have hidden because that would be a scary feeling, so he will likely get a settlement for emotional distress.”
