The Audacity of Dope

By John Cole October 23rd, 2008

Andy McCarthy’s rapid decline into sheer madness continues at an alarming rate, and there appears to be no bottom. Today, weary and worried that the Ayers/Rezko/Wright axis of associations is not doing the damage he had hope, he turns his eyes to another juicy prospect:

What is the deal with Obama’s birth certificate and citizenship status?

Pamela Gellers at Atlas Shrugs raises some apparent shenanigans with the birth certificate the Obama campaign previously produced. Meanwhile, Philip J. Berg, a former Deputy AG of Pennsylvania and a professed Hillary supporter, filed a lawsuit claiming Obama is not constitutionally eligible to be president; instead of simply clearing up any questions — which you would think would take about five minutes — Obama’s lawyers moved to dismiss the suit and failed to file a timely answer, meaning that, under the applicable rules (according to Berg), Obama is legally deemed to have admitted Berg’s allegations that he is constitutionally ineligible to be president.

The deep thoughts of contributors to the premiere website for conservative thought, ladies and gentleman- spreading nonsense from 9/11 Truther Philip Berg and insane whacko Atlas Jugs. Maybe he should head on over to the NRO’s Campaign Spot where Jim Geraghty can set him straight.

This isn’t even funny anymore. Between Jonah, K-Lo, and Andy McCarthy, this is really getting sad.

I am sure this has been posted somewhere on this blog but I can’t read one more thing today and just got it from a friend…
    Palin in the Oval Office

  2. 2 RML Says:

The fact that right wingers are pursuing this phony Birth Certificate story just highlights the fact that the Republican Party has become the bastion of morons no longer fit to lead this nation or anyone. Senator Obama has a security clearance with the United States Government to perform his Senate duties…If there was an issue on citizenship it would have come up during his background investigation. Believe me these clearances are not easy to obtain.

  3. 3 binzinerator Says:

    I got this far…

What is the deal with Obama’s birth certificate and citizenship status?

… and the snort-laughter began to bubble up, but when this followed as the answer…

    Pamela Gellers at Atlas Shrugs…

    I lost it completely.

Sorry, I’m still seeing the funny in it.

Our only hope is that these websites become so dense, they become information black holes, from which no information can escape.

I spent ‘way to much time clicking on stuff in the link in #1– ‘Uh oh’ was a good one.

  6. 6 Geoduck Says:

It’s amusing to note that McCain is the one who truly has to worry about being a Real American- he was born in the Panama Canal Zone..

  7. 7 Atanarjuat Says:

I agree that it doesn’t help to have Andy Martin, avowed anti-semite and serial lawsuit filer, make the "press conference" announcement in Hawaii yesterday that Obama’s father is not Barack Obama of Kenya, but Frank Marshall Davis, who is alleged to have had an affair with a very young Ann Dunham (BHO’s mother) while he was already married to another woman. Mr. Martin, of course, offers no evidence other than his own say-so.

This kind of carnival sideshow only serves to muddy the waters and distract from the valid concerns with regard to BHO’s birth certificate. There are some very good questions that have yet to be answered to everyone’s satisfaction that Barack Hussein Obama, Jr., is in fact an American citizen by birthright.

And you know what would happen if it were conclusively proven that BHO is actually a Kenyan (the main avenue of speculation) as opposed to a naturally-born U.S. citizen, right? BHO would be ineligible to be President of the United States of America, and his liberal socialist regime will be stopped dead in its tracks (as it should be).

    Country First.

    @Laura W:

    That site is awesome.

  9. 9 slammin' sammy Says:

this is no lie: I am not particularly enamored of Obama, and while there was no way in hell I was ever going to vote for McCain, after Obama’s vote on FISA and then the bailout I was inclined to vote third party. I was NOT going to vote for Obama.

But the descent of the GOP into despicable bottom feeder tactics and overt endorsement of racist fearmongering, appealing to the basest of its constituency, has turned me running into the Obama camp.

I truly feel I have to stand up against this, and I think every American concerned about the fate of our country needs to make a stand with this election, with this candidate. No more politics fueled by hate and fear.

To the GOP, all I can tell you is to take the advice that your Cheney gave to Patrick Leahy. You have ensured at least one vote for Barack Obama. Enjoy the wilderness, you’ve truly earned it.

  10. 10 Nim, ham hock of liberty Says:

For what it’s worth, I’m a lawyer. And out of morbid curiousity, I logged into Pacer and read through the pleadings filed in that Berg case.

There’s a simple reason why the response has been a motion to dismiss on the basis that Berg has no standing – it’s the fastest and cheapest way to kill the lawsuit. The alternative would be months of discovery – which is expensive – followed by pre-trial motions – which is expensive – and then possibly a trial. So, if you’re the Obama campaign, you can waste your time and money on all that, or you can file a short, simple motion to get rid of the case immediately, on the grounds that the court has no jurisdiction to issue the relief requested, because Berg has no standing to ask for it.
    Anything else would be stupid.

I’ll withhold comment on the quality of the pleadings.

With respect to the "OMG HE ADMITTED EVERYTHING" – the campaign filed a motion to toll the discovery response deadlines while its motion for summary judgment was pending. While I don’t fault Berg for moving to have the requests deemed admitted, there’s basically no way the Court grants that. Stranger things have happened, but the Court is NOT going to deem all of the ultimate issues in the case (and a lot of arguably irrelevant, inflammatory stuff) admitted, when motions to dismiss AND toll the response deadlines were pending.

  16. 16 Lev Says:

Andrew McCarthy? His best work is in the past, although he was really dreadful in Less Than Zero.

It’s really true, though. The GOP looks more to me like Old Labour these days than anything else: unelectable, out of touch, and positively angry that somehow the other side has bamboozled the public into believing their hateful garbage. Anyone want to take bets on how long the GOP spends completely out of power? I’m guessing at least sixteen years.

  20. 20 Delia Says:

And we thought the Vince Foster murder conspiracies were as far into the realm of political paranoid schizophrenia as you could go . . . . .

  21. 21 Nylund Says:

Obama CAN’T just spend 5 minutes to clear it up. Berg has this insane and mutually contradictory laundry list of internet rumors of about 30 different conspiracy theories regarding Obama’s citizenship (Obama might be Indonesian, Canadian, Kenyan, etc. (but not American!). He says the only way Obama can prove him wrong on each and every random rumor is if the DNC hands over every file they have on Obama, and Obama hands over basically every document from his entire life that bears his names including rejected applications for financial aid from his college days, etc.

The request is INSANE and there is no way Obama or the DNC would or should agree to hand over every single file about Obama over to some nutcase. On top of that, in order for Berg to claim he has the right to sue, he needs to list damages he suffered, and what would compensate him for those damages. He cannot give any reasons as to why he should be personally rewarded anything (or what he’d be entitled to), so if you can just end this nutcase’s lawsuit that way, OF COURSE you would. Who would hand over a lifetime of documents to some crazy person just because he filed a suit? And, who would be surprised to learn that when dealing with a completely ridiculous and stupid lawsuit that the Obama team might not have their eyes glued to certain deadlines.

I mean, seriously, read the lawsuit! It has lines like, "There is a rumor on the internet that Obama’s mother might have…."

At one point, he talks about how the Italian version of Wikipedia differs from the English version as proof that Obama must be lying. Its insane, its a joke, and the National Review should be absolutely embarrassed to side with Berg. Where was the National Review when Berg was claiming Bush and Cheney owed him money for planning and purposely causing 9/11?

  22. 22 Comrade Darkness Says:

This is what the Goopers had to say when the shoe was on the other foot:

But lawyers for the GOP and McCain wrote Thursday that Robinson lacks standing to sue and is asking the courts to tread where the Constitution forbids. cite

Which brings up an interesting question. If no one has standing to sue, then aren’t these rules unenforceable?

Laura, that website is all kinds of awesome. Mattf: did you find the pitt bull? And I notice today she has an officer tied up, the other day it was something else. And if you keep opening and closing the door, more things are there. BLAMbi!

  23. 23 gex Says:

    @slammin’ sammy:

I truly feel I have to stand up against this, and I think every American concerned about the fate of our country needs to make a stand with this election, with this candidate. No more politics fueled by hate and fear.

    That, sir, was truly beautiful.

  24. 24 eponymous coward Says:

Where was the National Review when Berg was claiming Bush and Cheney owed him money for planning purposely causing 9/11?

Discoursing on why it was obviously Hillary Clinton who shot Vince Foster from behind the grassy knoll, of course.

Maybe the NR staff need to bring Lyndon LaRouche on as a new contributor to replace Chris Buckley. It seems apropos if they are going to move off into conspiracy theory.

  25. 25 jdrhoades Says:

ISTR that it was about two weeks before the first Clinton victory over George the Elder when the right wingers started dredging up the truly crazy stuff that had been percolating for a while and throwing it desperately against the wall. "Clinton dealt drugs out of the Arkansas governor’s mansion!" Clinton killed a man!" Etc.

  26. 26 cjb Says:

If it’s in federal court, an answer doesn’t have to be filed until after the motion to dismiss is ruled on.

And Nylund is right — even procedurally Obama can’t just drop by the courthouse with his birth certificate and clear things up.

  27. 27 John S. Says:

BHO would be ineligible to be President of the United States of America, and his liberal socialist regime will be stopped dead in its tracks (as it should be).

    That’s some good troll.

    Whiny-ass titty baby? Check.
    Irrational paranoia? Check.
    GOP talking points? Check.
    Lack of critical thinking? Check.
    Unintentional irony? Check.

Actually, do you have a checklist you go by when you churn this stuff out?

  28. 28 Nylund Says:

The suit is so stupid He can’t even pick which internet rumor he thinks is true.

The basic idea is this: "Obama was born in Kenya, not Hawaii. If you can prove he was born in Hawaii, then I claim that OK, he was born in Hawaii, but then he moved to indonesia and got citizenship there and never reinstated his US claim. If you prove that wrong, then I have this Canadian birth certificate on the internet with his name on it. If you prove that wrong then I’ll point you to this one blog where this guys says that Obama…" and it just goes through dozens of embarrassingly stupid internet rumors which he claims Obama must address.

  29. 29 Just Some Fuckhead Says:

Between Jonah, K-Lo, and Andy McCarthy, this is really getting sad.

  30. 30 Tsulagi Says:

Yeah, there is NRO, but don’t forget that other bookend of stupid…RedState. You can’t count them out on something as vital as this issue. From the other “premiere website for ‘conservative’ thought” in Righty World, this late breaking update

*According to a report from Andy Martin in Hawaii, Sen Barack Obama is the illegitimate son of Frank Marshall Davis, the family friend mentioned in Dreams of My Father, Sen Obama’s first memoir. This would end the question of citizenship. Read it HERE:]*

That was tacked on to a recommended diary that’s been up awhile about the real reason Obama is traveling to Hawaii. You can’t fool those deep thinkers there with a sick grandma story. Nope, Obama is personally going to coerce the courts there to keep his birth records secret.

RedState, your one-stop shopping for Conservapedia intellect and tabloid truthiness. They should have a print version for their target readers they can take along when offline. That’d get some toes to tapping in approval.

  41. 41 Dungheap Says:

I like the summaries of the pleadings, but the real thing is priceless. You’ve got gems like this:

Upon investigation into the alleged birth of Obama in Honolulu, Hawaii, Obama’s birth is reported as occurring at two (2) separate hospitals, Kapiolani Hospital and Queens Hospital. Wikipedia English Version, under the subject “Barack Obama,” states Obama was born at Kapiolani Hospital. Wikipedia Italian Version, under the subject “Queens Hospital,” states Barack Obama was born in Queens Hospital.

With some of this sprinkled in for good measure:

It has been announced in the main stream media that Obama’s “briefing” has already begun into our National Secrets, our Nations Top Secrets, which Obama is not privy too and in violation of our National Security, as Obama is not a legal citizen of the United States. This has placed Plaintiff and other citizens of the United States in grave danger. Plaintiff’s Liberty as guaranteed will further be violated if Obama is allowed to be voted into and assume the position of President of the United States; Plaintiff will be further damaged and is in serious jeopardy.

Go nuts GOPers, hitch your wagon to this freak. It’s not as though you have any credibility left to lose.

  42. 42 Xenos Says:

Obama’s lawyers moved to dismiss the suit and failed to file a timely answer, meaning that, under the applicable rules (according to Berg), Obama is legally deemed to have admitted Berg’s allegations that he is constitutionally ineligible to be president.

Let me guess: Berg has never gone to law school, never passed a bar exam. This is the sort of procedural stuff you learn in the first month of law school.

In case anyone is worried, the requirement to file an answer within 20 days is suspended by a motion to dismiss. Suspended until the motion to dismiss is heard and decided. Then the calendar starts up again where it had stopped.

The more important point is that Berg has no idea what he is talking about, or is flat out lying here.

Now that’s uncalled for, John. I clearly stated that the Andy Martin BHO-true-father nonsense is just that, and no one with the capacity for critical thinking can ever take that "discovery" seriously (especially since proof is notably absent).

As I’ve already pointed out, just because one of the anti-Obama conspiracy theories are within the realm of a Bigfoot sighting, it doesn’t mean that the birth certificate issue should be any less legitimate or troubling.

Now please, show some balance. It would only be fair.

  54. 54 Steve V Says:

Xenos is right, assuming the motion to dismiss is still pending the Obama side does not need to file an answer.

As a lawyer who has represented large, deep pocketed defendants, I can tell you that it is simply SOP that you don’t give credence to nuisance suits. You move to dismiss them and, if applicable, have the plaintiff declared a vexatious litigant … which Berg apparently has already been found to be. Just about any lawyer knows when a lawsuit passes the smell test, or is instead pure nuisance litigation, and this Berg lawsuit clearly falls in the latter territory.

Moreover, the notion, peddled by any number of nonlawyers on the right, that "Obama could simply make this go away by coming forward with the information Berg seeks" is simply nonsense. It’s something an ignoramus says to get the freepers thinking conspiratorially — it isn’t something that any lawyer with an iota of integrity would say. The truly obnoxious aspect of this is that McCarthy knows ALL of this. If I recall his Wikipedia bio correctly, he once used to be an Assistant US Attorney. In general, AUSA’s are very bright and capable people. McCarthy may at some point have been such a person. He knows that the crap he just posted is utter bullshit on multiple levels but he’s posting it anyway. Are other conservative lawyers sinking to this level of disingenuousness (Patterico? The people at Volokh?)?

In case anyone is worried, the requirement to file an answer within 20 days is suspended by a motion to dismiss. Suspended until the motion to dismiss is heard and decided. Then the calendar starts up again where it had stopped.

The more important point is that Berg has no idea what he is talking about, or is flat out lying here.

Specifically, the rule in question is Federal Rule of Civil Procedure 12(a)(4), which states:

Unless the court sets a different time, serving a motion under this rule alters these periods as follows:

    (A) if the court denies the motion or postpones its disposition until trial, the responsive pleading must be served within 10 days after notice of the court’s action; or

    (B) if the court grants a motion for a more definite statement, the responsive pleading must be served within 10 days after the more definite statement is served.

So if the court were to deny his motion to dismiss (which it should easily grant), then Obama would have 10 days after the court’s order to answer the suit. Xenos is also right about two other points: this is first-month-of-law-school material, and Berg is either lying or completely ignorant of what he is talking about.

Oh, and the whole birth certificate issue? Total baloney.

  65. 65 Camarada Rommie Says:

My litmus test for these kinds of way-out revelations is this: "Okay, you were right! What now?"

In this case – imagine the press conference, in Obama’s voice:

"All right, you got me. You got me. I fooled everyone for all these years, and only now did that right-wing blog finally uncover the truth. I apologize to [blah] [blah] [blah]. I withdraw my nomination for President of the United States, and I regret the disappointment and humiliation I have brought to my family, my supporters, and the American People for [list of wrongdoings]. Thank You."

    Riiiiiiiiight.

    Surrealism, thy color is red.

Where to start. A stupid lawsuit was filed. Obama’s lawyers filed "an answer" called a motion to dismiss said lawsuit on the grounds that it was stupid. "Under the applicable rules", Berg, McCarthy and Atlass Juggs are asshats.

  68. 68 Kenneth Fair Says:

    (B) if the court grants a motion for a more definite statement, the responsive pleading must be served within 10 days after the more definite statement is served.

So if the court were to deny his motion to dismiss (which it should easily grant), then Obama would have 10 days after the court’s order to answer the suit. Xenos is also right about two other points: this is first-month-of-law-school material, and Berg is either lying or completely ignorant of what he is talking about.

Oh, and the whole birth certificate issue? Total baloney.

  69. 69 Joe Max Says:

This kind of carnival sideshow only serves to muddy the waters and distract from the valid concerns with regard to BHO’s birth certificate. There are some very good questions that have yet to be answered to everyone’s satisfaction that Barack Hussein Obama, Jr., is in fact an American citizen by birthright.

The frozen gorilla suit with possum guts is a kind of carnival sideshow that only serves to muddy the waters and distract from valid concerns with regard to the existence of Bigfoot. There are some very good questions that have yet to be answered to everyone’s satisfaction that Bigfoot the American Yeti, does in fact not exist.

  70. 70 Zuzu's Petals Says:

    @Laura W:

Yeah, I could never figure out what those "thwap thwap" sounds were…and then I listened all the way through. Gotta be a hockey game.

Yes on the dinosaur …there’s something else that flips by the window once in awhile, but not sure what.

It says "updated daily until November 4th" but who knows, maybe they just stick stuff in there when they feel like it.

    (I love the globe … "Iran-istan!" … "Somethin’-stan!")

I leave for Ohio on November 1 – thanks for asking. That reminds me, they’re looking for more volunteers…think I’ll post the note in a couple of threads.

  71. 71 kay Says:

Anyone can file a lawsuit against anyone, claiming anything.

    "State a claim". That’s it.

I thought the country was more "lawyered up" than this, I honestly did. People don’t know this?

The filing of a lawsuit means nothing. It means someone drafted a claim and paid a filing fee.

It reminds me of Right wingers claiming Kerry would have sued for "slander" were the Swiftboats claims untrue.

It’s next to impossible for a public figure to sue for slander.

  72. 72 Zuzu's Petals Says:

  73. 73 Mary Says:

42 – and as a former AUSA, McCarthy knows that, hence his completely disingenuous insertion of "(according to Berg)"

He can’t be that incompetent. Or maybe he is. Whatever.

  74. 74 gocart mozart Says:

Kenneth is right. A M2D is not an answer, but only tolls the deadline until a decision. I was right about the asshat part though.

  75. 75 JL Says:

@Laura W: If you haven’t already, click in between the desk doors and keep clicking, you’ll get a message. Supposedly they add something new each day, but hopefully not behind the door. There’s only so much bloodshed that I can take. I sent this to my repubs friends and they enjoyed it.

  76. 76 Jay C Says:

I think the Palin site gets a new "gotcha" every day or two: as is, I suffered a severe attack of ROTFLMAO – minutes long -

    Priceless.

  77. 77 John S. Says:

    Now please, show some balance.

Unfortunately for you my spoofy friend, facts have a well known liberal bias. I presume that is why you feel compelled to manufacture your own ‘facts’ that have a decidedly more conservative bent to them.

Alas, we cannot discuss the color of the sky as long as you persist in arguing that it is, in fact, a startling shade of plaid.

It would be irresponsible not to speculate whether Barack Obama is a space alien who helped NASA fake the Apollo landings to cover up the existence of his secret moon base where an army of Barack clones is developing a ray gun that will turn all Americans into socialist Muslims.

  80. 80 The Populist Says:

I thought republicans hated frivolous lawsuits!

  81. 81 kay Says:

It just makes me sad and tired.

ONLY Obama has to establish his own paternity.

What are they talking about, as a practical matter?

    It’s worth walking through it.

They’re now claiming he was fathered by a different man?

Why is no other candidate subjected to the "real father" test?

How does he prove it? Exhume two men and provide DNA samples?

Are we SURE we want to go there, in this country? Might end up with some interesting results if we subject every candidate to the "who’s your daddy?" test.

  82. 82 JL Says:

But seriously, as much as I want to laugh ’till I get snot-bubbles, McNasty (h.t. to the late Johnny Most) is still at 40% or so. I would have hoped the zombie-brained portion of the population was at a more Bush-like 25%. Doesn’t bode well for the nation long-term.

As for the birth certificate, were there IBM Selectrics in 1961? What’s the font? What is the fonnnnnttttt?

  86. 86 Notorious P.A.T. Says:

It will turn out that the woman that Drudge is currently featuring on his front page who is claiming that a robber beat her up and then when he found out she had an Obama sticker on her car supposedly carved a "B" on her face, did it to herself. I mean, notice anything suspicious about the picture?

Hmm, it looks like the assailant carved her while upside down.

OH, so that was the UH-OH referenced earlier. I never got that! I kept looking for the UH-OH. I did not know to click the phone twice.
My newest discovery are the notches on the middle of the desk! 15 W.K.s.
I fear a new obsession descending upon me. As if I need one more.

  88. 88 Laura W Says:

@donovong: that was beautiful. Thanks. I really enjoyed the Obama slideshows, Obama and Babies, etc, HuffPo has been posting. I get all teary and weepy-eyed.

  99. 99 Kathleen Says:

PP got here before me on the answer/motion to dismiss/default issue.

We can’t blame Andy McCarthy, I suppose, for not knowing that, but given how he relies on Berg’s totally erroneous statement on this issue, I would hope he realizes now how badly he’s been punked and publically retracts.

  100. 100 Comrade Darkness Says:

@Zuzu’s Petals: I guess it stands to reason that one person’s hockey game in another person’s angry mob. I thought it was as mob, lobbing things at the white house.

  101. 101 Tsulagi Says:

    @Punchy:
Not only the underage mother whose residence in the real America has not been established, but Obama has had plenty of time and opportunity to have a DNA test done to address paternity issues he knew would arise. That he has not done so speaks volumes.

  105. 105 r€nato Says:

You know, back in the old days, the true tinfoil-hatters would wave around notarized statements from witnesses, as if the act of having someone’s loony ravings stamped by a notary proved their veracity beyond the shadow of a doubt.

Today’s tinfoil-hatters just bark madly at the moon and hope there’s enough deluded idiots around who will listen to them. They’re not even trying anymore.

  106. 106 dslak Says:

From a Republican perspective, the carving of the ‘B’ into the woman’s face should be considered too good to be true. Also, it doesn’t really fit the profile of somebody who is robbing for money. It’s hard to believe somebody who just committed a robbery would return to the victim because he didn’t like their politics.

  107. 107 Nim, ham hock of liberty Says:

Gotta be pedantic here but y’all are analyzing the "admissions" issue incorrectly, because McCarthy has his own facts wrong. As I said, I’ve looked at the docket on Pacer and read the pleadings, for the hell of it.

Berg isn’t claiming that the complaint wasn’t answered, and therefore deemed admitted – he’s claiming that his requests for admission weren’t answered timely. That’s a different issue, procedurally.

Berg made his requests to admit in mid-September. The campaign has not answered those requests (which would be nothing more than a string of denials anyway), but has filed a motion to suspend the discovery deadlines while the motion for summary judgment is pending. There is very little chance they will lose this motion, or that the requests will end up being deemed admitted.

So the bottom line is mostly the same, but this isn’t about a responsive pleading to the complaint.

  108. 108 r€nato Says:

  114. 114 SGEW Says:

Has Obama submitted to a DNA test to prove that he is human?

Well, it don’t think it’s an Obama supporter at all. It looks more like the mark of Teh Batman!

  116. 116 jcricket Says:

Ah, conspiracy theorists. McCarthy is no different than the moon-landing-hoaxers. There is nothing Obama could do, short of bringing McCarthy back in a time machine into the past to witness Obama’s birth, that would convince Andrew he’s wrong.

Having watched conspiracy theorists spread their ridiculous theories for going on 20 years (back to many a flame war on USENET), the only difference is the target (politics).

But I’m fine with the right embracing the loons. Makes them look even sillier than their ideas do by themselves.

  117. 117 Jon H Says:

@22 "Which brings up an interesting question. If no one has standing to sue, then aren’t these rules unenforceable?"

It’s surprising that no GOP governor enacted eligibility checks as a requirement for getting ballot access. Enforcing a Constitutional requirement ought to be Constitutional, no?

  118. 118 Comrade Jake Says:

    @Mo:

Off the rails. She was a rabid Guiliani fan in the primaries.

You know, it’s funny, but in my experience some of the wingnuttiest righties were rabid Rudy fans. You can forget about trying to use facts, logic, or reason with these types.

  119. 119 Democrat Says:

Oh, over at NoQuarter folks are claiming that Obama’s mother doesn’t really look like him. I guess they’re suggesting that 47 years ago she just pretended to be a white teen having a biracial baby because….um…why was that?

  120. 120 tripletee Says:

    @r€nato:

Has Obama submitted to a DNA test to prove that he is human?

That’s the part of this whole thing that I find most troubling – even more so than the obviously fraudulent birth certificate and the unconvincing explanations of Obama’s paternity.

Without a DNA sample, we have no conclusive proof that Obama isn’t a mimetic polyalloy construct, sent back in time to prevent the future savior of the human race from ever being born.

I’d also point out that Sarah Palin (note the first name) is kind of crazy, good with guns, comfortable with survivalist groups, and she’s due to get pregnant again any time now. We have to establish whether or not Obama is a murderous time-traveling cybernetic organism before it’s too late.

  121. 121 Brick Oven Bill Says:

    Jcricket says:

“There is nothing Obama could do, short of bringing McCarthy back in a time machine into the past to witness Obama’s birth, that would convince Andrew he’s wrong.”

Barack should produce an original copy of his birth certificate, just like I had to produce to get my passport three years ago. It took me a week to get it re-issued. As a sitting Senator, that should take Barack two or three hours to put these rumors behind him.

  122. 122 Iowa housewife Says:

Has everyone who has run for president had to show their birth certificate? And if so, who do they show it to?

  123. 123 Comrade Jake Says:

    @Democrat:

Oh, over at NoQuarter folks are claiming that Obama’s mother doesn’t really look like him. I guess they’re suggesting that 47 years ago she just pretended to be a white teen having a biracial baby because….um…why was that?

They are full-bore stupid over there. It’s like they’re trying to win some kind of contest of idiocy.

  124. 124 I'mRubberYou'reGlue Says:

Not sure what the GOP is thinking here. Are they afraid that the White Supremacy vote might cross over to Obama if they don’t keep this shit up?

At this point every stunt they try backfires on them. They are more covered with soot than fucking Wile E Coyote’s face.

  125. 125 Iowa housewife Says:

  126. 126 Comrade Darkness Says:

@Iowa housewife: Must not have, to run anyway. George W. Romney, the father of Mittens Romney was born in Mexico, yet still ran for president in 1968, losing out to Nixon for the republican nomination.

From the wikiped: Romney was born to American parents in a Mormon colony in Mexico. His family moved back to the United States when he was a child.

    also

After deciding to wait out the 1964 election, Romney announced on November 18, 1967, that he had "decided to fight for and win the Republican nomination and election to the Presidency of the United States". Polls in 1967 showed him the leader among rank and file Republicans, especially among the "moderates". Romney’s membership in the Mormon church was a factor in his campaign, with attention focusing on his church’s policy at the time of not allowing blacks to participate fully.[12]

You can read more here should you care to. According to this source, he lost not because he wasn’t a natural born American, but because he pulled a Manchurian Candidate on himself.

Off the rails. She was a rabid Guiliani fan in the primaries.

That’s rich in the same way that the claims of Krugman being an "alleged economist" were when he won his Nobel. As if it’s really that hard to check something like this.

  129. 129 kommrade jakevich Says:

@Democrat: That’s because they look at his mother and see an attractive Caucasian woman.

And there’s the Moose Queen, whom he made what she is today – bought her nice clothes and everything, running around doing her own thing like he was some senile old uncle. Pretty soon the folks Johnny Drama’s gonna have left in his corner are Cindy and the birth certificate hunters. And I’m not so sure about Cindy.

  143. 143 Zuzu's Petals Says:

Omigosh, check it out now. They’ve added at least four more "Joes." And the flowers now speak !

  144. 144 Catsy Says:

You just don’t understand. Philip Berg is a fucking genius, and I stand in awe of his accomplishments.

Berg’s lawsuit is, as McKinnon notes, "a complete distillation of every claim the Cult of the COLB (ed: Certificate of Live Birth) has ever made, in bite sized legal form." What McKinnon fails to realize is that that was Berg’s intent all along. Berg is putting to rest, once and for all, every last one of the Vince Foster-esque "is Obama a US citizen" conspiracy theories, all at once. He has assembled them and given them what all conspiracy theories fear the most: being empirically tested. When his lawsuit is scathingly laughed out of court–as it will be–it will relegate this to the realm of alien abduction and tinfoil brigades.

Berg is a genius. I just hope he’s able to hide his ties to the Obama campaign.

  145. 145 pseudonymous in nc Says:

There’s a simple reason why the response has been a motion to dismiss on the basis that Berg has no standing

There’s precedent that regular voters lack standing. Just who has standing, I dunno. At times like this, it would be nice to have a constitutional court that can clarify points like ‘born abroad to American parent, eligible under Article II?’ absent a ‘case’ or ‘controversy’, but there ya go.

  146. 146 Chum Says:

Didya see the picture of the location? A street corner. Yeah sure, he really took his time holding down a victim on the sidewalk on a streetcorner and ever so lightly scratching not an "O" but a perfectly formed captail "B"

and that black eye. So swollen, all most shut it is.

  147. 147 Conservatively Liberal Says:

I am reading the wingnut ‘outrage’ at Obama flying in his campaign jet to Hawaii to see his Grandmother, and their attempts to contrast this as an outrage compared to their dressing up their bulldog like a poodle just falls flat. First, it is his ill Grandmother, there are going to be Secret Service considerations that flying the campaign jet would resolve and it is not something that is being dug up from campaign filings. Obama was up front with this and that is all that matters. His Grandmother raised him and this might be his last chance to see her. I hope that she recovers, that they get to see a lot more of each other and that she lives to see him sworn in as President.

Having donated to his campaign, I hope that a little of my cash is paying his way to see her. At least it’s not being wasted on appearance or vanity in dressing up a bulldog.

  148. 148 Tattoosydney Says:

    @Catsy:

Shhhhhh! Some of them have almost worked it out:

This seriously erodes my confidence in the credibility of Mr. Berg.
Mr. Berg apparently doesn’t understand basic civil procedure.
Discovery cannot be served before the parties have conducted a discovery conference. See Federal Rule of Civil Procedure 26(d). Because that hasn’t been done yet, Mr. Berg’s discovery is improper and need not be responded to.
Second, a motion for a protective order is a response to a discovery request and relieves the moving party from the obligation to respond until the motion is resolved by the court. See Rule 26(c) and the cases interpreting that rule.
Is Mr. Berg ruining this case because he’s an incompetent attorney, or is he sabotaging the case on purpose?
Is there any way for a competent and dedicated attorney to intervene and take this over so it is handled right and we don’t get thrown out for failing to follow the procedural rules?

    from the comments here.

  149. 149 Delia Says:

    @Conservatively Liberal:

Agent Flowbee is on top of the Obama-sick grandmother situation. He has determined that Obama’s grandma is not really sick and he’s just sneaking off to Hawaii to relax for a couple of days before he returns to finally destroy America.

And no, Flowbee still hasn’t found the whitey tape.

I think I’m still missing one, but then, I’m not really fully functioning yet. (I plan to resume full functionality on Nov 5, 7am EST. I’ll be up extry early to sneer at Pat B and Morning Blow.)

BTW, MSNBC is covering Palin’s "Policy Address" live. God Bless CNN for not doing so, and now showing it as "moments ago". I heard "Autism" and muted sound immediately. Uh oh…Trig is going to be our teacher for years to come. I can hardly wait.

[...] That of course was wrong. Broad categories of victims just dilutes the hell being inflicted. Back in my day we’d pick a single kid to take the brunt of our displeasure. Not just fists, but cruel remarks and all the shit that goes into ruining a kid and producing a frightened adult who obsessively contemplates ways in which Barack Obama can be taken off the ballot before November. On Topic; its been goddamn YEARS Obama has been in the public eye. Really the Rethugs think that within a 12 day window they are going to prove that Obama is ineligable.

    Dumbasses.

If you file a motion to dismiss under Rule 12, you don’t have to file an answer until after the motion is heard. If the motion is granted, then you don’t have to file an answer at all; if it is denied, the court usually sets a time to file answer or allows it to be determined by Federal or Local Rule.

Try to keep in mind one thing in all this back and forth on the nutters:

TO THEM, IT’S ABOUT THE MONEY.

The rightist nutjobs know how to track hits. They know there is a built-in 33 percent audience for this crack. They DON’T CARE about being proven or disproven. They CARE ABOUT HITS! And the more hits we send their way, the more we inadvertently support them.

Now I’m all for Cole and Sadly and Greenwald etc. … making major fun of them. But we should also be aware that we may in fact HELP them by giving them undue attention. They will always sell their conspiracy/con-job cow floppery to the 22 percent of Texans who believe O is a Muslim. That is all they can do to survive. The best revenge is to make them all go broke by failure. Then some serious money might go to the REAL CONSERVATIVES who need to rebuild that party so we can have a strong two-party system.
