Andy McCarthy’s rapid decline into sheer madness continues at an alarming rate, and there appears to be no bottom. Today, weary and worried that the Ayers/Rezko/Wright axis of associations is not doing the damage he had hope, he turns his eyes to another juicy prospect:
What is the deal with Obama’s birth certificate and citizenship status?
Pamela Gellers at Atlas Shrugs raises some apparent shenanigans with the birth certificate the Obama campaign previously produced. Meanwhile, Philip J. Berg, a former Deputy AG of Pennsylvania and a professed Hillary supporter, filed a lawsuit claiming Obama is not constitutionally eligible to be president; instead of simply clearing up any questions — which you would think would take about five minutes — Obama’s lawyers moved to dismiss the suit and failed to file a timely answer, meaning that, under the applicable rules (according to Berg), Obama is legally deemed to have admitted Berg’s allegations that he is constitutionally ineligible to be president.
The deep thoughts of contributors to the premiere website for conservative thought, ladies and gentleman- spreading nonsense from 9/11 Truther Philip Berg and insane whacko Atlas Jugs. Maybe he should head on over to the NRO’s Campaign Spot where Jim Geraghty can set him straight.
This isn’t even funny anymore. Between Jonah, K-Lo, and Andy McCarthy, this is really getting sad.

The fact that right wingers are pursuing this phony Birth Certificate story just highlights the fact that the Republican Party has become the bastion of morons no longer fit to lead this nation or anyone. Senator Obama has a security clearance with the United States Government to perform his Senate duties…If there was an issue on citizenship it would have come up during his background investigation. Believe me these clearances are not easy to obtain.

I agree that it doesn’t help to have Andy Martin, avowed anti-semite and serial lawsuit filer, make the "press conference" announcement in Hawaii yesterday that Obama’s father is not Barack Obama of Kenya, but Frank Marshall Davis, who is alleged to have had an affair with a very young Ann Dunham (BHO’s mother) while he was already married to another woman. Mr. Martin, of course, offers no evidence other than his own say-so.
This kind of carnival sideshow only serves to muddy the waters and distract from the valid concerns with regard to BHO’s birth certificate. There are some very good questions that have yet to be answered to everyone’s satisfaction that Barack Hussein Obama, Jr., is in fact an American citizen by birthright.
And you know what would happen if it were conclusively proven that BHO is actually a Kenyan (the main avenue of speculation) as opposed to a naturally-born U.S. citizen, right? BHO would be ineligible to be President of the United States of America, and his liberal socialist regime will be stopped dead in its tracks (as it should be).

this is no lie: I am not particularly enamored of Obama, and while there was no way in hell I was ever going to vote for McCain, after Obama’s vote on FISA and then the bailout I was inclined to vote third party. I was NOT going to vote for Obama.
But the descent of the GOP into despicable bottom feeder tactics and overt endorsement of racist fearmongering, appealing to the basest of its constituency, has turned me running into the Obama camp.
I truly feel I have to stand up against this, and I think every American concerned about the fate of our country needs to make a stand with this election, with this candidate. No more politics fueled by hate and fear.
To the GOP, all I can tell you is to take the advice that your Cheney gave to Patrick Leahy. You have ensured at least one vote for Barack Obama. Enjoy the wilderness, you’ve truly earned it.

For what it’s worth, I’m a lawyer. And out of morbid curiousity, I logged into Pacer and read through the pleadings filed in that Berg case.
There’s a simple reason why the response has been a motion to dismiss on the basis that Berg has no standing – it’s the fastest and cheapest way to kill the lawsuit. The alternative would be months of discovery – which is expensive – followed by pre-trial motions – which is expensive – and then possibly a trial. So, if you’re the Obama campaign, you can waste your time and money on all that, or you can file a short, simple motion to get rid of the case immediately, on the grounds that the court has no jurisdiction to issue the relief requested, because Berg has no standing to ask for it.
Anything else would be stupid.
I’ll withhold comment on the quality of the pleadings.
With respect to the "OMG HE ADMITTED EVERYTHING" – the campaign filed a motion to toll the discovery response deadlines while its motion for summary judgment was pending. While I don’t fault Berg for moving to have the requests deemed admitted, there’s basically no way the Court grants that. Stranger things have happened, but the Court is NOT going to deem all of the ultimate issues in the case (and a lot of arguably irrelevant, inflammatory stuff) admitted, when motions to dismiss AND toll the response deadlines were pending.

It’s really true, though. The GOP looks more to me like Old Labour these days than anything else: unelectable, out of touch, and positively angry that somehow the other side has bamboozled the public into believing their hateful garbage. Obama CAN’T just spend 5 minutes to clear it up. Berg has this insane and mutually contradictory laundry list of internet rumors of about 30 different conspiracy theories regarding Obama’s citizenship (Obama might be Indonesian, Canadian, Kenyan, etc. (but not American!). He says the only way Obama can prove him wrong on each and every random rumor is if the DNC hands over every file they have on Obama, and Obama hands over basically every document from his entire life that bears his names including rejected applications for financial aid from his college days, etc.
The request is INSANE and there is no way Obama or the DNC would or should agree to hand over every single file about Obama over to some nutcase. On top of that, in order for Berg to claim he has the right to sue, he needs to list damages he suffered, and what would compensate him for those damages. He cannot give any reasons as to why he should be personally rewarded anything (or what he’d be entitled to), so if you can just end this nutcase’s lawsuit that way, OF COURSE you would. Who would hand over a lifetime of documents to some crazy person just because he filed a suit? And, who would be surprised to learn that when dealing with a completely ridiculous and stupid lawsuit that the Obama team might not have their eyes glued to certain deadlines.
I mean, seriously, read the lawsuit! It has lines like, "There is a rumor on the internet that Obama’s mother might have…."
At one point, he talks about how the Italian version of Wikipedia differs from the English version as proof that Obama must be lying. Its insane, its a joke, and the National Review should be absolutely embarrassed to side with Berg. Where was the National Review when Berg was claiming Bush and Cheney owed him money for planning and purposely causing 9/11?

The basic idea is this: "Obama was born in Kenya, not Hawaii. If you can prove he was born in Hawaii, then I claim that OK, he was born in Hawaii, but then he moved to indonesia and got citizenship there and never reinstated his US claim. If you prove that wrong, then I have this Canadian birth certificate on the internet with his name on it. If you prove that wrong then I’ll point you to this one blog where this guys says that Obama…" and it just goes through dozens of embarrassingly stupid internet rumors which he claims Obama must address.

Let me guess: Berg has never gone to law school, never passed a bar exam. This is the sort of procedural stuff you learn in the first month of law school.
In case anyone is worried, the requirement to file an answer within 20 days is suspended by a motion to dismiss. Suspended until the motion to dismiss is heard and decided. Then the calendar starts up again where it had stopped.
The more important point is that Berg has no idea what he is talking about, or is flat out lying here.

Xenos is right, assuming the motion to dismiss is still pending the Obama side does not need to file an answer.
As a lawyer who has represented large, deep pocketed defendants, I can tell you that it is simply SOP that you don’t give credence to nuisance suits. You move to dismiss them and, if applicable, have the plaintiff declared a vexatious litigant … which Berg apparently has already been found to be. Just about any lawyer knows when a lawsuit passes the smell test, or is instead pure nuisance litigation, and this Berg lawsuit clearly falls in the latter territory.
Moreover, the notion, peddled by any number of nonlawyers on the right, that "Obama could simply make this go away by coming forward with the information Berg seeks" is simply nonsense. It’s something an ignoramus says to get the freepers thinking conspiratorially — it isn’t something that any lawyer with an iota of integrity would say. The truly obnoxious aspect of this is that McCarthy knows ALL of this. If I recall his Wikipedia bio correctly, he once used to be an Assistant US Attorney. In general, AUSA’s are very bright and capable people. McCarthy may at some point have been such a person. He knows that the crap he just posted is utter bullshit on multiple levels but he’s posting it anyway. Are other conservative lawyers sinking to this level of disingenuousness (Patterico? The people at Volokh?)?

In this case – imagine the press conference, in Obama’s voice:

Gotta be pedantic here but y’all are analyzing the "admissions" issue incorrectly, because McCarthy has his own facts wrong. As I said, I’ve looked at the docket on Pacer and read the pleadings, for the hell of it.
Berg isn’t claiming that the complaint wasn’t answered, and therefore deemed admitted – he’s claiming that his requests for admission weren’t answered timely. That’s a different issue, procedurally.
Berg made his requests to admit in mid-September. The campaign has not answered those requests (which would be nothing more than a string of denials anyway), but has filed a motion to suspend the discovery deadlines while the motion for summary judgment is pending. There is very little chance they will lose this motion, or that the requests will end up being deemed admitted.
So the bottom line is mostly the same, but this isn’t about a responsive pleading to the complaint.

Without a DNA sample, we have no conclusive proof that Obama isn’t a mimetic polyalloy construct, sent back in time to prevent the future savior of the human race from ever being born.
I’d also point out that Sarah Palin (note the first name) is kind of crazy, good with guns, comfortable with survivalist groups, and she’s due to get pregnant again any time now. We have to establish whether or not Obama is a murderous time-traveling cybernetic organism before it’s too late.

You just don’t understand. Philip Berg is a fucking genius, and I stand in awe of his accomplishments.
Berg’s lawsuit is, as McKinnon notes, "a complete distillation of every claim the Cult of the COLB (ed: Certificate of Live Birth) has ever made, in bite sized legal form." What McKinnon fails to realize is that that was Berg’s intent all along. Berg is putting to rest, once and for all, every last one of the Vince Foster-esque "is Obama a US citizen" conspiracy theories, all at once. He has assembled them and given them what all conspiracy theories fear the most: being empirically tested. When his lawsuit is scathingly laughed out of court–as it will be–it will relegate this to the realm of alien abduction and tinfoil brigades.
Berg is a genius. I just hope he’s able to hide his ties to the Obama campaign.

I am reading the wingnut ‘outrage’ at Obama flying in his campaign jet to Hawaii to see his Grandmother, and their attempts to contrast this as an outrage compared to their dressing up their bulldog like a poodle just falls flat. First, it is his ill Grandmother, there are going to be Secret Service considerations that flying the campaign jet would resolve and it is not something that is being dug up from campaign filings. Obama was up front with this and that is all that matters. His Grandmother raised him and this might be his last chance to see her. I hope that she recovers, that they get to see a lot more of each other and that she lives to see him sworn in as President.
Having donated to his campaign, I hope that a little of my cash is paying his way to see her. At least it’s not being wasted on appearance or vanity in dressing up a bulldog.
