Square Enix, Inc. and its affiliate companies (collectively "SQUARE ENIX", "we" or "us") are committed to protecting the privacy of our on-line visitors, customers, users and other participants (collectively, "Users" or "you"). Accordingly, we have established this Privacy Policy ("Privacy Policy") that sets forth how we collect, store and use information that you provide us online. Please note that this Privacy Policy does not apply to information you may provide to SQUARE ENIX offline, or to any third party websites that SQUARE ENIX does not control. This Privacy Policy and the certification seal located on this page confirm that SQUARE ENIX is a valid licensee and participating member in the Entertainment Software Rating Board's Privacy Online Program: ESRB Privacy Online. To protect your privacy, we have voluntarily undertaken this privacy initiative and all of our websites have been reviewed and certified by ESRB Privacy Online to meet established online information collection and use practices. As part of this privacy program, we are subject to frequent audits of our sites and other enforcement and accountability mechanisms administered independently by the ESRB.

What personal information does SQUARE ENIX collect?

There are various ways in which Users may submit personal information to SQUARE ENIX, including: (1) the purchase of goods or services though our online stores, such as merchandise, game discs/cartridges or manga; (2) product or account registration, or registration for on-line games such as FINAL FANTASY XIV or others; (3) message boards or forums; (4) emails or in-game chats; (5) warranty registrations; (6) contest or sweepstakes entries; (7) consumer comments or complaints; (8) surveys; (9) customer service or technical support; and/or (10) optional screenshots that a User may choose to post online. Personal information collected may include your name, home address, phone number, and/or e-mail address. It is not necessary to provide this information to gain access to SQUARE ENIX websites, although, if you do not provide it, you will not be able to utilize certain products, services and features.

Users who purchase products or services will be required to provide additional information such as a valid credit card number, expiration date, and shipping and billing addresses. Please note that SQUARE ENIX uses third party payment processors for certain transactions, including all transactions conducted through the SQUARE ENIX Account. Accordingly, in those instances, such third party processors––not SQUARE ENIX––will be receiving your personal information subject to their own privacy policies.

What types of non-personal information may SQUARE ENIX collect?

In order to access certain services, you may be required to provide non-personal information such as a user name, password, your age, date of birth, gender, and/or game and platform preferences. This information may be combined with your personal information for customer service or security purposes. In addition, your computer or console may transmit certain geographic information or information regarding your computer (e.g., IP address, capabilities, game data processing, etc.) to SQUARE ENIX. SQUARE ENIX may use this information to generate aggregate statistics about our user community and may provide such information to advertisers and/or our partners. In addition, SQUARE ENIX may use such information for security, system integrity (the prevention of hacking, cheats, etc.), or enforcement purposes (such as to investigate, identify and/or prosecute Users conducting illegal or prohibited activities).


How do we use your personal information?

SQUARE ENIX uses personal information to: provide the services that you may request from us; complete transactions such as purchases or monthly billing; ship goods that you purchase; respond to your requests for help or information; verify that you are qualified to use the online services; investigate, identify and/or prosecute Users conducting illegal or prohibited activities, or any activity that SQUARE ENIX, in its discretion, deems inappropriate; notify you of changes to the licenses and agreements necessary to use the online services; notify you of changes to the online services; send you updates or newsletters; notify you about contests, promotions, and special events; and for internal marketing, profiling and demographic purposes. In addition, SQUARE ENIX may use or disclose personal or non-personal information in the good faith belief that we are required to do so by law, such as in response to any subpoena or other legal disclosure obligation. Please be advised that in some areas of our websites, you may be able to submit information about yourself in a business capacity (such as making a media request or submitting your résumé as part of a job application). Although we can assure you that any personal information gathered in such a way will be used solely for its intended purpose, such information is not subject to this Privacy Policy.


Who is collecting your information?

When you are asked for information while on a SQUARE ENIX website, you are sharing that information with Square Enix, Inc., its parent, and its various affiliates and sister companies around the globe. In addition, some services are provided in conjunction with third party vendors. Vendors are independent entities that provide support for the internal operations of our websites and who only use the information we share with them (or that they collect on our behalf) for purposes of internal fulfillment (e.g., online product fulfillment or payment processing). For example, we may share personal information with entities as necessary to process credit card payments for purchases you make on our websites and to ship your products to you. Please note that SQUARE ENIX currently uses third party vendors to process all payments made under the SQUARE ENIX Account, including but not limited to purchases of Crysta and subscription fees for FINAL FANTASY XIV. When you purchase these goods or services, the third party vendor––not SQUARE ENIX––will be receiving your personal information. Whenever SQUARE ENIX provides your information to a third party vendor, it contractually requires the third party vendor to protect, safeguard and keep confidential your personal information in accordance with industry standards, and to use the data only for its intended purpose. Please be aware that we cannot control the activities of third parties to whom we provide data, and as such we cannot guarantee that they will actually adhere to the same privacy and security procedures as SQUARE ENIX. If you do not want your information shared, you can choose not to allow the transfer of information by not using that particular service.Please be aware that this Privacy Policy does not apply to advertisers, websites with links to our websites, or websites linked to from our websites.


With whom may your personal information be shared?

SQUARE ENIX may need to disclose your personal information to its publishing partners or third party vendors to provide certain services, to fulfill product orders or prizes, to process mailings, or to process, analyze, and/or store data on SQUARE ENIX's behalf. We will attempt to ensure that these entities do not use your personal information for any other purpose, and that they have agreed to maintain the confidentiality, security, and integrity of the personal information they obtain from us. We reserve the right to disclose your personal information as required by law or in special cases when we have reason to believe that disclosing such information is necessary to identify, contact, or bring legal action against you if you are violating any terms of use, license agreement, or any other contract with SQUARE ENIX, or if you may be (intentionally or unintentionally) causing injury to or interference with SQUARE ENIX's rights or property, other users of a SQUARE ENIX site or product, or anyone else who could be harmed by your activities. We also reserve the right to disclose your personal information if we have a good faith belief that it is necessary to prevent fraud or other illegal activities. As with any business, your personal information is also an asset of SQUARE ENIX and will become part of our normal business records. As such, we may also disclose your personal information to a third party if we decide to sell a line of business to that third party, so you can continue to receive service and information in connection with that line of business with as little disruption as possible. Similarly, in the event of a merger, acquisition, reorganization, bankruptcy, or other similar event, your personal information may be transferred to SQUARE ENIX's successor or assign. SQUARE ENIX sites may also have message boards, forums, and/or chat areas, where Users can exchange ideas and communicate with one another. When posting to a message board, forum, or chat area, please be aware that the information is being made publicly available on-line and the User does so at his or her own risk.


What choices do I have regarding the collection, use, and distribution of my personal information?

If, at any time, you wish to opt-out of having your personal information shared with third parties for marketing purposes and/or receiving information from SQUARE ENIX about new products, services, or promotions, you can do so. Just send an email to na.privacypolicy@square-enix.com. Be sure to type "opt-out" in the subject line, and include your full name, member ID, and email address in the message. In addition, along with almost every communication sent to you, SQUARE ENIX provides you the opportunity to discontinue receiving future communications (i.e., unsubscribe). Please note that, if you subscribe to an online game or other services, SQUARE ENIX may continue to send you certain important game-related news and updates (e.g., when the Terms of Use or Software License are updated, or in case prices change, etc.).


California Residents: Your California Privacy Rights

Under California law, our customers that are California residents may request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. As detailed above, we do not share our customer's personal information with unaffiliated third parties for direct marketing purposes without their approval. What is the policy regarding children?

Children Under 13

SQUARE ENIX does not collect any personal information from children under the age of 13, unless the child's parent or legal guardian completes and submits a signed parental consent form permitting the child to enter a particular sweepstakes, contest or other promotion for which children under 13 are eligible. In this instance only, SQUARE ENIX may collect only the information reasonably necessary to conduct the sweepstakes, contest or promotion, and to deliver the prize. All personal information collected will be deleted or destroyed within thirty (30) days. SQUARE ENIX does not collect any information from children in a manner inconsistent with the Children's Online Privacy Protection Act ("COPPA"). Note to Parents

SQUARE ENIX strongly encourages parents and legal guardians to take an active role in supervising Internet use by their children, protecting their children's privacy, and preventing inappropriate uses of information about their children. Does SQUARE ENIX use cookies, IP addresses, or other similar means of collecting information?

Cookies

Cookies are a feature of your Web browser that allows Web sites to transfer bits of information to your computer for record-keeping purposes. A cookie stored on your computer can be used to "remember" things like your password, or that you have already registered. This allows us to speed up your future activities, saving the time you would normally spend entering information such as your password or registration. In addition, SQUARE ENIX may use cookies to retrieve user information for promotional, marketing, or security purposes.


Internet protocol addresses

An Internet protocol ("IP") address is the unique number assigned to your server or Internet Service Provider ("ISP"). SQUARE ENIX may track such IP addresses for system administration, to report aggregate information, site tracking, security purposes, or to prevent our servers from being abused.


Log files

SQUARE ENIX may collect information in the form of logs: files that record website activity and gather statistics about web users' browsing habits. For most websites, these entries are generated anonymously, and help SQUARE ENIX determine (among other things) how many and how often users visit our websites, which pages they visit, and other similar navigational data. However, certain log files may contain personal information which we may use in accordance with this Privacy Policy.


Beacons

Web beacons are small pieces of data that are embedded in images on the pages on some of our websites. We may use beacons to analyze the traffic patterns on our websites, such as the frequency with which Users visit various parts of our websites, or in HTML e-mails that we may send to our Users to determine whether those e-mails are opened or whether the links in the e-mails are followed. Certain data obtained from beacons may contain personal information which we may use in accordance with this Privacy Policy.


What do I do if I want to correct or delete my personal information?

How secure is my personal information?

SQUARE ENIX has taken steps to assure that all information collected will remain secure and in its original form, i.e. free from any alteration. As such, access to all personal information is strictly controlled and stored in firewall-protected servers. When personal information is transmitted, for example, we use industry standard, SSL (secure sockets layer) encryption. In addition, we will take reasonable steps to assure that third parties to whom we transfer any data will provide sufficient protection of personal information. We will notify Users of a data breach involving unencrypted personal information by email or by posting a notice on the affected website. We also strive to limit access to personal information to employees or contractors performing a legitimate business function. We review our security procedures periodically to consider appropriate new technology and updated methods. Despite our efforts, no security measure if ever perfect or impenetrable.
