The same idiot court that has not looked into the issue of whether or not schedule I cannabis is rational because it is a regulation of commerce of a fungible substance and therefore rational. Despite dubious facts that boarder on lies, such lies don't matter when you regulate commerce because you never look at those facts as a judge. You simply read the law and say that's not what the law says. It's a legislative matter of line drawing, foolish for sure, but legislative nonetheless. This is why the evolution of our rights has taken so long.
Legislative and executive government actions are subject to judicial review. This enables the other branches of government to act independently as their political masters so desire. They must get elected in order to rule as their voters want them to rule. However, this rule of men can backfire and run contrary to the Constitution. It can do this for decades as segregation, sexism, homophobia and even the marijuana laws (the moral leftovers of alcohol prohibition) clearly illustrate.
