April 15, 2011

Today Marc Emery learned that the United States has denied his request for a transfer to Canada to serve out the remainder of his jail sentence. Mr. Emery has been serving a five-year term imposed after his guilty plea to selling marijuana seeds in order to finance worldwide cannabis law reform efforts.

"This refusal is a terrible affront to the sovereignty of Canada," said Mr. Emery's Canadian counsel, Kirk Tousaw. "Marc is a target of political persecution that appears to have transcended his conviction and now infects the treaty transfer process. He qualifies under every relevant factor and should have been allowed to serve out his jail term in Canada, close to his wife Jodie and in the country in which all of his activity took place. We call upon Prime Minister Harper and the leaders of the Liberal Party and NDP to stand up for this Canadian hero and demand his immediate repatriation."

Mr. Emery's wife Jodie was devastated by the news. "I'm absolutely shocked and sickened that the United States refused the transfer. Marc has never harmed anyone and has devoted his life to fighting oppression. He has been punished for speaking out for the rights of tens of millions of cannabis consumers here and in the US and it's truly frightening. Canadians who feel Marc has been treated unfairly with an unjust five-year US prison sentence for seeds should punish the Conservatives in the federal election on May 2nd for extraditing Marc in the first place"

Even the circumstances surrounding Mr. Emery learning of the refusal are peculiar. "It is impermissible under the professional conduct rules in the District of Columbia for lawyers to communicate directly with a represented person, or cause others to communicate with a represented person, without going through their lawyer. Here, neither I nor Ms. Royce (Emery's US lawyer) were told of the US refusal. Instead, the US apparently told the Canadian Consulate first and it was the Consulate that informed Marc. This is very unusual and should not have happened. It makes me wonder whether the US and Canada are engaged in ongoing dialogue about Marc and lends support to the belief that politics are still influencing the process," explained Tousaw.

Mr. Emery has the right to re-apply in two years time. His supporters vowed to exhaust every option to secure his swift return to Canada.

Just wanted to let everyone know that I'm still around. There will be an updated article on the 420 event in Washington DC tomorrow. Henry Fox was gracious enough to go and represent the Kentucky USMJParty and met quite a few interesting folks there.
I, unfortunately, was not able to attend, as I was / am in the process of relocating to a new place!
I am looking forward to a new environment and a chance to catch up on Kentucky politics before the Governor's race in November! GOOOOOOOOOOOO GATEWOOD!

Medicinal marijuana advocate loses battle with cancer

Medical marijuana advocate Michelle Rainey died Wednesday night from cancer, which she had been battling for more than a year.

The 39-year-old passed away at her home in Maple Ridge with her husband, Jeff Tek, and her mother Emilie at her side.

“The drug and peace movement has lost a warrior,” said her friend and fellow activist David Malmo-Levine.

Rainey was receiving high doses of an experimental tumour-fighting cannabis treatment to fight melanoma and lymphatic cancer when she died.

"While the treatment didn't save her," Malmo-Levine said. "There is important information that needs to be looked at."

Diagnosed with an inflammatory bowel disease at 17, Rainey was in the middle of a successful 10-year banking career when she had to undergo two surgeries to remove damaged parts of her bowel.

For years, a cocktail of prescription drugs failed to curb the disease’s symptoms, so she tried marijuana to relieve her nausea.

It worked and she was able to wean herself off every prescribed medication.

Rainey joined the marijuana movement in the late 1990s after meeting self-proclaimed Prince of Pot Marc Emery while working at a bank in Gibsons.

Together, they started the B.C. Marijuana Party and she helped Emery run his multi-million dollar cannabis seed business.

In a statement posted on cannabisculture.com earlier this month by Emery, he wrote: “Considering the considerable pain her health has given her, she was heroic in so many ways and represented the movement with class and clout.”

Rainey was his “teammate”, the person who made sure his employees were paid, “marijuana seeds were shipped on time, the producers paid and happy, the media fully informed, Pot-TV running smoothly.”

Rainey and Emery’s relationship soured after they and Greg Williams were indicted in the U.S. on charges of growing marijuana, conspiracy, seed sales and money laundering.

In July 2009, Rainey and Williams were sentenced to two years probation in Canada. Emery decided to sign a plea deal for a five-year sentence, which he is currently serving in a U.S. federal prison.

In Maple Ridge, Rainey was an articulate and vocal advocate for the medicinal marijuana movement, speaking out recently in support of marijuana dispensary and against a bylaw to prevent medical grow operations in Pitt Meadows.

She was at the helm of an alternative medicine journal, Treating Yourself Magazine, and helped many navigate the maze to get a medical marijuana exemptions from Health Canada.

Emery wrote: “She was an engine for great change in the world, committing money, her health, and her whole soul into this great movement that is forever in debt to her.”

A memorial for Rainey is being planned.
