Saints suing over nude photo scandal

The St Kilda Football Club intends on suing the teenage girl at the centre of the nude photo scandal.

The Federal Court today extended an order preventing the 17-year-old from publishing more photos of AFL players on the internet.

The girl - who cannot be named - did not appear at the hearing, nor did she have a representative there.

Outside court, Saints vice-president Ross Levin said it was just the beginning of a vigorous legal campaign against the girl and added the players intend on suing for damages.

"When you get an order for damages, in the event we are successful in our claim, the order continues to be valid for up to 15 years," Levin said.

"In the event that she tries to make money out of this, the misery she has caused to these four undeserving players, then we'll be looking for that money."

Mr Levin said if the girl disobeyed the judge's orders, she could be held in contempt of court which carries serious penalties.

"The woman clearly knew what she was doing when she published those photos," he said.

"We at the club, and all fair-minded people we would say in Australia, have been appalled at the delight that she has expressed in causing distress to these four players including, as I have said, some whom she has never met and who have never done anything to her.

"The woman has made it clear in her networking posts that basically she enjoys causing trouble for others."

Earlier this week the teen published photos featuring Saints skipper Nick Riewoldt and team-mates Nick Dal Santo and Zac Dawson on social networking site Facebook.

The players claim the photos were taken by another team-mate, Sam Gilbert, while on holiday in Miami last year.

Gilbert says the girl stole the photos from his computer, but she maintains she took them herself while with the players in a Melbourne hotel room.

Justice Shane Marshall said the best evidence available to him at present is that the photos were taken from Gilbert's computer.

In orders to be emailed to the girl and posted on her Twitter account, Justice Marshall instructed that, for now, she not publish the photographs or any other images or videos taken from Gilbert's computer.

Gilbert's lawyer, Will Houghton, QC, will make an application to the court at 2.15pm (AEDT) on Friday that the girl be ordered to permanently delete all electronic images from her computer.

He said the girl was deliberately thumbing her nose at the court.

"It appears ... that [the girl] is exhibiting some defiance to the orders of this court and whether that is because of her immature years or simply plain stupidity, I cannot say," he told the court.

A lawyer for Facebook spoke to the court from the United States via telephone and said the company was committed to deleting all inappropriate content posted on its website.

    The AFL and Saint Kilda club shouldnt be offering this (foootballer @#$%) councelling take her to court it's blantantly clear of her intensions if she intends to release more photos (other clubs included) so what if she had a fling with one of the players what was this little bi#*#chs intentions? if she thought by doing a concenual act by becoming pregnant would give high profile status she was mistaken all she has done is made it known who and what she is

          What is it about these so called 'lewd' images that the court has moved to prevent them from being posted on a website? Why is everyone running for cover? We'll soon know because court order or no court order they'll surface somewhere and then the shiz will really hit the fan!

            Her name is Kim Duthie. Easy enough to find if you google. The pics are easy to find as well, just google their names and you'll find them. I saw them last night. Nothing special, just a couple of naked guys. The funniest part is the look on Nick Riewoldt's face

                Any vision I've seen or heard of this young girl is disturbing. She's clearly not well..........and is going to find herself in an enormous amount of trouble unless she gets some sound advice.......and soon!!

                  Huh? The AFL is suing for damages because of the publication of gay pictures that the players volutarily posed for, taken by one of their `mates'? Don't like their chances. The idea that the girl `stole' the pics is ridiculous. How did she access Gilbert's computer? How did she know the pics were their? Most likely, Gilbert showed them to her. So, why not sue Gilbert?
