  • This Privacy Policy forms part of the Sets of Conditions.   
  • We take your privacy very seriously and we will hold all your Personal Information securely.
  • We are registered as a Data Controller with the Information Commissioner"s Office in accordance with the Data Protection Act 1998 (our registration number is Z6639808).
  • Payments are processed by a third party on our behalf: we do not hold your credit or debit card details anywhere in our systems.
  • By agreeing to any one or more of the Sets of Conditions, you give Us permission to collect, use and transfer your Personal Information.
  • Your Personal Information will be used only for the purposes set out in this Privacy Policy and will not be kept by us for longer than necessary.
  • We guarantee that we will not sell or rent your Personal Information to third parties, or disclose your Personal Information to any third party (unless it is a third party acting on our behalf as explained in this Privacy Policy or unless disclosure is required by law).
  • We will use reasonable efforts to make sure that you do not receive spam email as a result of registering with the Website or using the Services.

For the avoidance of doubt, the definitions listed in the Sets of Conditions (being the Terms and Conditions, Library Terms and Conditions and Corporate Terms and Conditions (all as defined below)) shall apply throughout this Privacy Policy also, except where the definitions conflict, in which case the definitions in this Privacy Policy will prevail for this document only.  The other definitions used throughout this Privacy Policy are contained in the Full Length Privacy Policy below.

This Privacy Policy forms part of our Sets of Conditions. By accepting any one or more of our Sets of Conditions, you consent to our collection, use and transfer of your Personal Information for the purposes outlined in this Privacy Policy.

1.      Definitions

means the terms and conditions between us and individual consumers seeking access to the services on the Website;

means the terms and conditions between us and relevant libraries seeking access to the services on the  Website;

Corporate Terms and Conditions

means the terms and conditions between us and corporate customers seeking access to the services on the Website; and

2.      What Personal Information do we collect and how?

2.1     We will collect and may hold information about you, including but not limited to, your name, address, phone number, email address, Records you have searched & images you have viewed, transaction information (the number, amount and time of payments you have made to us) credit/debit card details and billing address details ("Personal Information").  Your credit or debit card information is entered on the Website and thereafter immediately transferred to the secure payment gateway operated by our secure third party payment services provider. We do not hold your credit card or debit card information, including your account number, anywhere on our database or server once transferred to the secure payment gateway.

2.2     We collect Personal Information from you when you complete registration forms and order forms on the Website or directly from us.   

2.3.    We also collect Personal Information from cookies (small information files sent out automatically by the Website and then stored on your PC).

2.4     We collect Personal Information from your computer"s IP (Internet Protocol) address and browser configuration.

2.5     We may collect Personal Information about you should you contact us.

3.      Keeping your Personal Information secure

3.1     The Personal Information that we collect about you will always be used lawfully and in accordance with the Data Protection Act 1998.

3.2     We will hold all Personal Information about you securely and in accordance with our own internal security policy. In doing so, we will keep all of your Personal Information on a secure server and comply with all applicable UK data protection and consumer legislation from time to time in place.

3.3     Although we will do our best to protect your Personal Information and keep it secure, unfortunately the transmission of information via the internet is never completely secure and we can therefore not guarantee the security of your Personal Information transmitted to the Website and any transmission is at your own risk.  Nevertheless, once we have received your Personal Information, we will use strict procedures and security features to try to prevent unauthorised access.

4.      Use of your Personal Information

4.1    We confirm that any Personal Information which you provide to us shall be used only for the following purposes and shall not be kept longer than as is necessary to fulfil these purposes:-

4.1.1  to process your requests, manage your Accounts with us, and let you know of important things that affect you, for example changes to the Website or our Sets of Conditions;

4.1.2 to help diagnose problems with our server, to collect general report    information and to administer the Website;

4.1.3  to understand what you want and provide you with better products, services and information and to notify you by post or telephone and of any products or special offers that may be of interest to you;

4.1.4  to carry out research (for example, market research); and

4.1.5 we use cookies on a limited basis to improve the performance of particular Website pages, to help us analyse how our users use the Website and to help us regulate restrictions applicable to Free Trial Offers.

4.2     Notwithstanding Clause 4.1.5, you can choose not to accept cookies. However, this may prevent certain features from working fully. If you remove the           cookies we cannot guarantee that you will be able to benefit from all of our facilities. In particular, we will not be able to prevent you being charged again to look at an image you have already paid to view. Where we use third party companies to process your data on our behalf (for example, to send you emails on our behalf or about our products or process your payments to us), they may also use tracking technology, such as cookies.

5.      Disclosing your Personal Information

5.1     We will not disclose your Personal information to any third party except as in accordance with this Privacy Policy or as required by law or any regulatory obligation to which we are subject.

5.2     Subject to Clause 5.4, we guarantee that we will never sell or rent your Personal Information to third parties.  By not selling or renting your Personal Information to third parties (other than as set out in Clause 5.4) we strive to ensure as far as is reasonably practicable that you do not receive spam mail as a result of registering with this Website or using the Services, however unfortunately we cannot guarantee this. 

5.3     Subject to this Clause 5, we will only disclose your Personal Information to our employees and brightsolid online innovation limited (our parent company) and companies working on our behalf on a contractual basis

5.4     We may disclose your Personal Information to third parties if we, or substantially all of our assets, are acquired or are in the process of being acquired by a third party, in which case Personal Information held by us, about our customers will be one of the transferred assets.

5.5     The Personal Information we collect from you may be transferred to, and stored at, a destination outside the European Economic Area (“EEA”). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers processing such Personal Information on our behalf. Such staff may be engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services. By agreeing to one of the Sets of Conditions, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your Personal Information is treated securely and in accordance with this Privacy Policy.

5.6     Where we use third party companies to process your Personal Information on our behalf, these companies are bound by strict contractual provisions with us and have no right to use your Personal Information except on our behalf and only for fulfilling the task they have been contracted to do.

5.7    In accordance with Clause 4.1.1, we may send you various types of emails to provide you with information about your Account. The most common types of emails are listed below:-

  • Newsletters and Product Updates;
  • Tips and Special Offers;
  • Service Announcements and Welcome and Administrative emails.

We always try to make sure that you know what type of email you are receiving and why, by placing this information at the bottom of every email we send out.

We send Service Announcement emails when we need to provide you with information that may affect your use of a product or service. For example, we may send a Service Announcement if there is a disruption of service, a change in price or a major change to the service.

We may automatically send Administrative emails when you take certain actions such as changing your password. We may also send Welcome messages that are informational and provide details about service activation or product usage instructions when you sign up for the service.  

5.8     We need to be able to send you Service Announcements, Administrative or Welcome emails which you will not be able to unsubscribe from.  However, should you no longer wish to receive any other emails from us (e.g. marketing or competition emails), you can stop receiving such emails by visiting the Website, writing to us at the postal address at the end of this Privacy Policy or following the instructions at the bottom of the communications.

6.      Updating your Personal Information

6.1     We aim to keep the Personal Information we hold about you accurate and up-to-date. If you tell us that we are holding any inaccurate Personal Information about you, we will delete it or correct it promptly.

6.2     We offer you three options for changing and updating Personal Information about yourself:

6.2.1  modifying your User details through the "My Account" link once logged-on to the Website; or

6.2.2  sending an email to support@findmypast.co.uk; or

6.2.3  writing to the postal address provided at the end of this Privacy Policy.

7.      Accessing your Personal Information

         If you would like access to the Personal Information that we hold on you, you can do this by emailing us at dataprotection@findmypast.co.uk. We may make a nominal charge of £10 to cover administration costs.

8.      General

8.1    We reserve the right to modify or change this Privacy Policy at any time by making changes on line, with or without notice to you and you confirm that we shall not be liable to you or any third party for any change to this Privacy Policy from time to time. It is your responsibility to check regularly to determine whether this Privacy Policy has changed.
