Blog Sherpa Terms and Conditions

Lonely Planet knows that community members like you have some of the best travel experiences, ideas and information on offer. We are really excited about you sharing your blog (Blog) with the rest of the Lonely Planet community via Blog Sherpa.

Set out below are the terms and conditions that apply to your participation in Blog Sherpa, so please read them carefully. By clicking “I accept” below you are acknowledging that you have read and understood these terms and that you agree to them.

In these terms and condition, “we” refers to Lonely Planet Publications Pty Ltd and its affiliates.

Participating in Blog Sherpa

To join Blog Sherpa, you must first be a registered user of www.lonelyplanet.com. You must, at the time of accepting these terms and conditions, provide us with your:

· Lonely Planet website username; and

· Google AdSense identification number.

Once you have accepted these terms and conditions and provided the above information, Lonely Planet will establish your Blog Sherpa account and provide you with the support documentation. The Blog Sherpa support documentation will set out how you can submit posts from your Blog to Blog Sherpa.

Lonely Planet’s use of your Blog Posts

You grant us a non-exclusive, worldwide licence to reproduce and communicate the Blog Posts you submit to Blog Sherpa (Blog Posts) on our website www.lonelyplanet.com, including all pages on the site and any substitution, mirror or successor sites, micro-sites and any foreign-language versions of the site.

We will not use your Blog Posts for any purpose other than the one described above without your prior consent. We have no obligation to use your Blog Posts, including displaying them on our website. However, if we do use your Blog Posts it will be in accordance with these terms and conditions.

We will include a link from every Blog Post to your Blog. We will try to attribute authorship but it is not always possible. So, you consent to us not attributing authorship to you, or only attributing using the title of your Blog.

What should and shouldn’t be included in your Blog Posts

We have chosen your Blog because we think it represents the best of what travellers have to offer each other. So, you must ensure that all Blog Posts are travel related and do not:

· breach any laws or other people’s rights, including intellectual property rights;

· be racist, sexist or homophobic, or defame, harass or attack another person;

· disclose personal details or private information about any other person (or do anything else that is contrary to our privacy policy);

· advertise your or any other person’s goods or services; or

· contain any excessively coarse language or content, or anything that would be rated R, RC or X by the Australian Classification Board (for more information please see the Office of Film and Literature Classification website at www.oflc.gov.au).

So that we can ensure your Blog Posts appear on the most appropriate pages of our website, you must appropriately tag your Blog Posts in accordance with any guidelines we provide you. We may edit tags but will not otherwise edit your Blog Posts.

You must submit your Blog Posts to us in accordance with any requirements described in the Blog Sherpa support documentation and any other requirements we notify you of from time to time.

Your Blog Posts must comply with our editorial principles http://lplabs.com/2008/12/15/blogsherpa-editorial/.

Your use of Lonely Planet content

You may use text from destination information pages in your Blog Posts but you must attribute Lonely Planet by including a link from the relevant text in your Blog Post to the relevant page on our site. You may not use any images or maps in any way without our permission.

We will provide you with a Blog Sherpa badge kit. You may use the Blog Sherpa badge kit to create a widget linking your Blog to our website. Your use of the Blog Sherpa badge kit, including our trade marks, is subject to the guidelines we provide you and you may not otherwise use our trade marks in any way or for any purpose without our permission. We may prevent your use of our trade marks at any time, for any reason.

Ending your participation in Blog Sherpa

We can remove your Blog Posts and/or terminate your participation in Blog Sherpa at any time, including if we reasonably believe that:

· your Blog Posts are not travel related;

· your Blog Posts do not comply with the our editorial principles;

· the advertising appearing in conjunction with your Blog Posts does not comply with our advertising guidelines; or

· you have otherwise breached these terms and conditions.

You can end your participation in Blog Sherpa at any time by removing the Blog Sherpa tags from your Blog Posts.

We cannot guarantee that Blog Sherpa will operate uninterrupted or fault free, or that we will continue to operate Blog Sherpa forever.

If your participation in Blog Sherpa ends for any reason, you agree to stop using, and remove from your Blog, all Lonely Planet content, including all parts of the Blog Sherpa badge kit.

Advertising

It is your responsibility to establish and maintain your Google Adsense account. You must advise us of any relevant changes to your account details.

You must comply with Lonely Planet’s advertising guidelines, which we may update from time to time by notice to you, including ensuring that your Google Adsense account filters any advertisers or advertisements that are prohibited by Lonely Planet.

Your privacy

In registering on our website, registering for Blog Sherpa, or just be contacting us, you will supply us with personal information. We will only use your personal information to administer and help you use Blog Sherpa. Where you have opted in to receiving more information from Lonely Planet, your information will be used for that purpose too. You can view Lonely Planet’s privacy policy at http://www.lonelyplanet.com/legal/privacy-policy.

Your warranties to us

You warrant to us:

· that you are over 18 years old and you have the authority to enter into this agreement; and

· that the Blog is original to you and your own work, and that any third party content included in your Blog and Blog Posts does not infringe any third party intellectual property or other rights.

Liability

Blog Sherpa is provided to you “as is”. We make no warranties or representations about Blog Sherpa and exclude, to the maximum extent permitted by law, any liability which may rise as a result of its use. We are not responsible to you or anyone else for any loss, damage, liability, cost or expense suffered in connection with the use of Blog Sherpa.

We will never be liable for any indirect, incidental, special or consequential loss, or loss of profits or revenue arising out of the use of the site. You indemnify us and the other Lonely Planet companies against each claim, action, proceeding, judgment, damage, loss, expense or liability incurred or suffered by, or brought, made or recovered against us or the other Lonely Planet companies in connection with any breach by you of these terms.

Any disputes will be dealt with under the laws of Melbourne, Australia.
