The creation
of Parliamentary and State Assembly seats is done through view
and delimitation exercise as provided for under Article 113 and
the 13th schedule of the Federal Constitution.
Article 113 (4) of the Federal Constitution has a provision
to authorise other elections if the Feeder or State Laws allow
it. The Commission has conducted an election to a Local Authority
/ Council previously and Section 19 of the Election Offences
Act 1954 gives details of election expenses allowed. However,
due to the declaration of emergency under the Emergency (Essential
Powers) Act 1964, on September 18, 1964 elections to the Local
Authority were suspended. This suspension was never lifted and
in 1976 Local Authority elections were abolished. Instead, all
councilors are appointed by the State Authorities.
