Some of the reasons there have been solicitations for help with the expenses are because official government agencies are refusing to honor federal subpeonas. They want individual signed court orders by the judge commanding them to obey. In the case of Hawaii, their AG wrote Phil refusing to obey and demanding an Hawaiian Federal Court subpeona. That means they are trying to cost Phil so much with big fees for serving them, them t get them issued again.

Now ask yourself, why would the Hawaiian AG (or any governmental agency) refuse to honor a federal subpeona? What is it they are hoping to hide by delaying obeying long enough thinking the judge will dismiss the suit? Are these people conspiring with Obama to subvert the Federal Court system and deny the Aemrican people justice and truth? And Obama has a "Truth Squad"???

Who do these Obaminator trolls think they are fooling? They aren't fooling me. How about you? Could someone who is knowledgeable about this case post about the timeline of events going forward? Such as when the Court would rule on the Motion to Dismiss, then assuming Mr. Berg gets a favorable ruling, the amount of time Obama would have to provide the documents? Why doesn't Mr. Obama simply provide his "vault" copy of his birth certificate and the other two documents asked for in this suit? Wouldn't be difficult at all. “St. Louis County Circuit Attorney Bob McCulloch, St. Louis City Circuit Attorney Jennifer Joyce, Jefferson County Sheriff Glenn Boyer, and Obama and the leader of his Missouri campaign Senator Claire McCaskill have attached the stench of police state tactics to the Obama-Biden campaign.

“What Senator Obama and his helpers are doing is scandalous beyond words, the party that claims to be the party of Thomas Jefferson is abusing the justice system and offices of public trust to silence political criticism with threats of prosecution and criminal punishment.

“This abuse of the law for intimidation insults the most sacred principles and ideals of Jefferson. I can think of nothing more offensive to Jefferson’s thinking than using the power of the state to deprive Americans of their civil rights. The only conceivable purpose of Messrs. Obama is the only one who has access to the actual birth certificate (if it actually exists) and he hasn't seen fit to make it available.

Where is the media coverage on this issue?
It can't be that hard to produce a birth certificate....most people keep theirs in a lock box or fire safe box either in their bank or in their home.
Obama has one of the biggest campaign staffs in history, so certainly someone could take a moment and provide something besides a registry of birth, which ISN'T a birth certificate...that is, IF there is one.

If you haven't already heard Jerome Corsi and Tim Bueler are OUT of Kenya! I got the message last night right at the end of the Debate.

They were taken to the Airport by Guards with Automatic Weapons and when they were put on the plane they were told "Don't ever come back! See you in Hell"!

Okay, let me get something straight here; Niki, two things about the US Citizenship thing mentioned and this was in Berg's suit.

1.)IF Obama was born in Kenya, US citizenship would NOT matter because he is NOT a "natural born" citizen of this country; therefore he won't be able to run for President. .

2.)IF Obama was born in Hawaii he would be a US citizen and natural born UNTIL he moved to Indonesia and was adopted by his indonesian father to attend school there until he was ten years old. During that time Indonesia did NOT allow dual citizenship (neither did the US) so Obama and his mother had to relinquish their US citizenship and become Indonesian citizens. For Obama to attend school there his father would have had to adopted him as his son since no foreigners were allowed to attend school in Indonesia. Therefore Obama would have become a "natural born" child in Indonesia.

Now about the Oath of Allegiance. I don't think he took the Oath of Allegiance for this country because if he did wouldn't he respect the flag?

There are a lot of question marks out there regarding Obama. I don't trust him and I don't like the things I'm reading about him. I damn sure don't want him as our President now that all this information has come out about him and his past.

All these liberals are so brainwashed by Obama's lies (he's been lying this whole campaign) and everyone supporting him is buying it. He doesn't care for this country because if he did he would salute/respect the flag. He will tear it apart when he becomes President and Mr. Berg is trying to prevent that from happening. The Constitution is the highest law in the land and Obama is breaking that ever important law.

They just posted an article on Fox news that cleared Mrs. Palin on Troopergate. Her husband was the one that kept pressuring the commissioner to fire the trooper because that trooper was threatening their family; she was kept in the dark and when he (her husband) pressured her about it she finally said "Drop it." He did what anybody would have done in that situation to try and get a dangerous man off the street. It was nothing criminal. I have no problem with that. Family is supposed to help each other.

I have been watch the site , listening to the radio interview and researching myself. Tonight there was about 1.5 hrs that I was getting a site crashed repair error on the links and then when accessing the site. I seriuosly wondered if something foul had happened. My guess is that the Obama camp is gravely concerned about this fradulent citizenship issue and are forming a defense to launch when the story breaks. The problem was a software error that occurs occasionally. I had not seen this particular error before. Now, that I know about it, it will take 5 minutes to fix it if it happens again.

Even if ballots have been printed, etc., there are ways to deal with last minute changes -- Minnesota and Missouri did it when US Senate candidates died just days before the election.

The biggest problem comes with what to do with absentee ballots that are already being cast in some places. If Hillary were candidate instead of Obama, would the people who've already voted absentee have voted differently??

In the last Town Hall debate with McCain, when it came to the question about supporting Israel, he did not hesitate to state his support and defense of Israel. Reason: He is a Muslim. hiding under a Christian facade, very much like his benefactor and new owner of the Democratic party, George Soros - Jewish by birth, yet hates all Jews, is Pro-Muslim and was a Nazi Collaborator, during WWII. He passed himself off as a Christian and turned in his own people that had valuables and money for the Nazis to confiscate. (I read a Q & A interview with Soros where he admitted he collaborated with the Nazis).

If you haven't read Dr. Corsi's book, there is a reference to an interview held by one,Nicholas Kristof, a journalist for the New York Times, whereby Kristof questioned Obama on his Islamic education in Indonesia. This inteview was never published in the NY Times (gee, I wonder why?) He admitted to Kristof that [he] got into trouble for making faces during Koran study in class, and then Obama recited the opening line of the Arabic call to prayer. This is called the Adhan- the Muslim call to Prayer, A few lines follow:
"Allah is supreme!..... I witness there is no God by Allah". Here's the best part: Kristof said Obama recited the Prayer "with a first rate accent."(Arabic, that is) And the "Change Candidate" for President described the call to prayer "as one of the prettiest sounds on Earth at sunset."

I consider Philp Berg, the "Great American Hope," for the truth to emerge and pray that Judge Barclay Surrick is a Constitutionalist, when it comes to his decision and will be strong enough not to pressured by external forces. The Republicans cannot bring up this issue that Obama may indeed, not be an American, it would play out as Racist; look what he did to Hillary and Bill Clinton when Hillary was getting the better of him - the race card. He has played the Race card through the entire campaign when questioned on any issue he refuses to answer.

In support of Philp Berg's lawsuit, I found a link to a petition to Rally Congress to call on Obama to produce his constitutional qualifications that entitles him to run for President. I suggest that everyone who has blogged here on Philp's blog and on the direct Obamacrimes blog, go out via this link and sign the Petition that will be sent to their Congressmen and Senators. This would be an indication that we mean business and most of their seats are up at this election cycle. The more pressure we put on Congress and the Senate via petitions, it can only help Philip Berg in winning for the Ameican People and upholding our Constitution. I've only recently stumbled onto information about this lawsuit & website. I find it absolutely horrifying that Mr. Berg has had to resort to this measure to bring this issue to the surface, but thank God that he has. It's even more horrifying to think that this heinous fraud that has been paraded in front of the country by the DNC, Obama, et al has been allowed to continue all this time! I have seen a look at Obama's "official" birth certificate, and I can assure you that in 1961, NOTHING that was typed on a typewriter looked like that. And the typewriter was the only vehicle on which to produce such documents back then. There was no such thing as a printer, which is what appears to have produced his "birth certificate".
So, I join all of you in support of your mission to expose the truth and preserve our Constitution and our country. Mr. Berg, please keep up the honorable work. I am backing up my support by sending you a modest contribution. May God bless you and this monumental effort.

First and foremost, you admit that you are a Canadian.............what is your motive here? Did you learn and study the US Constitution in history classes in Canada? Do you understand our election processes? Why do you care?

Here's something that maybe you will understand. My husband has a dual citizenship - USA and Canada. His mother is American citizen and his father is Canadian citizen. He was BORN in Canada - his birth certificate is Canadian. He has a social security card, pays his US taxes and will be eligible for US Social Security when he retires. He does not work under a Green Card or have Visa status. In every respect, he is an American....We live in the state of Washington and travel to Canada quite frequently. My husband carries as US Passport, however, it lists his place of birth as: Canada..............are you getting the picture now?!?!?!

No matter how much my husband considers himself an American citizen (which, technically he is because of his mother's US citizenship) - however, he can NEVER run for President...........

Phil Berg's case is legitimate. As US citizens, we require this as a pre-requisite for the highest political office in the land. That is in the Constitution. That is the whole point of Berg's lawsuit.........we have a right to know if Obama is indeed a ligitimate US citizen and is eligible to elected President. Period.

Before you pop off here like you know what you are talking about, just remember this - you are a foreigner - NOT an American citizen. You should temper your comments with that in mind.

The United States Constitution has been the core of law and the foundation of this country for over two hundred years and is in sad decline the last several years.

You've got your facts all screwed up.

First: She didn't fire her ex-brother in law. He still is an Alaska State Trooper today.

Second: The reasons for potentially firing him included tasering his 10 year old stepson, shooting a moose illegally, drinking in his patrol car while on duty.

The person she fired was the public safety director, a member of her cabinet, who served strictly at the will of the governer and, she didn't actually fire him. She offered him a different position and, rather than take it, he resigned.

Just to state the facts, Palin has been cleared of the charges in troopergate. Tolstoy is a liar and must be related to Obama.

Given the tactics being put in to play to stall the proceedings and the refusal to produce a verifiable birth certificate, I believe a certificate is no longer good enough. There needs to be demonstrative verifiable proof perhaps from multiple angles and sources. Its just too easy to produce a fake "vault" birth certificate. Its just a piece of paper and anything can be done with photo shop.

You must also get the following records:

Immigration : Kenya and US in 1961
Passport : Records of Stanley Ann and Obama (What was he issued in Kenya in 1961?)
Airline : American Airlines? British Airways? They will have paper trail.
Hospital : Eye witnesses in Hawaii and Mombassa
Next Door Neighbours : Their inside stories, they love to gossip, both in Hawaii and Kenya.

This was an unusual 'looking' family especially in those days, so there are many eyewitnesses about.

Whatever reason Obama has for hiding the truth..

eg:
1. Embarassment of actual name 'Obama Hussein Mohammad Barak'
2. His listed religion 'Islam'
3. Name of his mother, listed with maiden name Durham, as in Kenya
she wouild not be recognised as Mrs Barak, as naturally he was already
married. So adding to her embarassment and ill treatment she expressed,
by Barak family.

I can imagine this is a very personal issue for Obama, as upon reading his unusual life story and
families circumstance, it is clear that his father never divorced from first wife, yet can imagine
Stanley Ann's father forced her to marry out of shame. Then when she got to Kenya she
would have been shocked to find out the truth. Possibly Mr Obama was able to take more than
1 wife, being Muslim? Anyway, Ann was unable to leave due to heavy pregnancy, she was forced
to remain to give birth.

I can understand she would want to forget forever her situation and experience, and it is even quite
plausible that she kept the truth of 'place of birth' from Obama, until he was obviously going to find
out later when he was to 1.meet his father & Kenyan family and; 2.Applying for passports and travel
documents (USA-Indonesia-Pakistan-etc..).

AS A SMALL BUSINESS OWNER AND EMPLOYER I AM NOT ABLE TO HIRE AN EMPLOYEE WHO I DON'T VERIFY IS LEGAL TO HIRE.

So how is it that America would be 'allowed' to hire someone for the most important job in the country without verifying that they are legally able to accept the position????

This a common sense question and it is a LAW the rest of us are required to follow. If I had any doubt in my mind as to the authenticity of the paperwork provided by a potential employee I would not hire them. Bottom line!

I checked this out and order a photo. Will someone please explain to me if a back ground check is required of a President? I know this is a little off subject but there are a lot of people of like minds here. I just have a question.

Would it be legal to stand outside the buildings when people are voting on Nov 4, as long as you are the proper distance away, and video people going in and out? I wonder how many people would take a chance of voting repeatedly if they knew there might be proof on video. I have heard there are many people that use the vote of a dead person and various other methods in order to vote more than once.

I realize that registering more than once is different than voting more than once. Voter fraud is a felony and most people would not be willing to take a chance if they thought they might get caught. If they saw people filming, they may not go back and vote a second time.

So, is it illegal to stand outside, or inside, the buildings and just videotape people going in and out? Not in a threatening or obstructive way, just videotaping.

If each precinct had one or two people standing around videotaping it might act as a deterrent. Especially in those states that do not require ID.

Just a thought.

Only the judge knows. He has a history of being slow, but fair from what I've been able to find out about him. All we can do is wait.....and pray.

Why have we not heard this on CNN or some of the major networks. we have what 22 days are we all nuts.
We are going to let this happen, there is no way that you will get these people to vote otherwise.

I have written to all my congress, only to have it come back as the server is full. I have written to CNN. They go to factcheck.org for thier source of truth "fair and balanced" right. I did some research on my own and found that Annenberg funds factcheck.org and also is Obama's old employer. How fair is that. People are looking for a savior and found Obama.

AMERICAN SENATOR BARACK OBAMA'S POORLY INFORMED COMMENTS ABOUT TERRORISM, WANTED GENOCIDE CRIMINALS AND GOVERNANCE IN KENYA


Senator Barack Obama indicated that he was visiting Africa to help nurture relations between the continent and the United States. His mission, therefore, was warmly welcomed by the Government and the people of Kenya. The fact that he has roots in Kenya endeared him to the people of this country.

However, during his public address at the University of Nairobi, Senator Obama made extremely disturbing statements on issues which it is clear, he was very poorly informed, and on which he chose to lecture the Government and the people of Kenya on how to manage our country.

We would like to make the following facts clear:

a) Kenya is no less vulnerable to terrorism than the United States or any other country. Kenya has in the past suffered incidents of terrorism because of our friendship with the United States and not because as a people, we are less efficient in the management of our security. Indeed, his own country and other countries with higher levels of development, have had more incidences of terrorism despite their sophisticated security systems. Therefore, blaming terrorist attacks in Kenya on possible corruption is highly misplaced and insincere. Using his logic, then, it follows that the terrorist attacks in the United States and other countries are as a result of corrupt border and customs police in his own country and other countries which have experienced incidents of terrorism.

b) The allegation that wanted Rwandese genocide fugitive Felicen Kabuga may have purchased safe haven in Kenya is an insult to the people of this country and negates the fact that Kenya, Rwanda and the United Nations have an excellent track record in collaboration in the search and apprehending of Rwandese suspects. This country has turned over to the United Nations Criminal Tribunal for Rwanda the highest number of genocidal suspects for trial. For that reason also, this country cannot be a safe haven for any genocide suspect and especially Kabuga. If it was an issue of corruption money, as Senator Obama states, then the bounty of US$5 million (Kshs 365 million) being offered by the United States for the apprehension of Kabuga, would be irresistible to the alleged corrupt police. If anybody knows where Kabuga is, this Government would like to know so that we can apprehend him immediately and hand him over to the tribunal.

c) Senator Obama enjoyed the vibrant freedom of expression and wide democratic space existing in this country, during his tour. Instead of acknowledging this big leap in this country, he chose to dwell on none issues as far as the governance of this country is concerned. He ignored the fact that strengthening of democracy and institutions of Governance has been the strongest thrust of this Government. Today, every Kenyan can openly talk about and address issues of corruption without fear and associate himself or herself to any political party he or she chooses. Bold decisions have made to bring down the rate of corruption with great success. For example, the success in our fighting corruption is evidenced by the fact that Kenya is one of the best performing countries in Africa in the collection of public revenue and the economy has had a turn-around from near zero percent (0%), three years ago, to about six percent (6%) economic growth today. This cannot be achieved in a country, which Senator Obama says, is experiencing a "corruption crisis."

d) Senator Obama also trivialized the harmony and peaceful co-existence that exists between different ethnic groups and races that live in this country, and chose to magnify tribalism as a major problem in this country.

During Senator Obama's visit, the Government spared no effort in making his stay and travel all over the country enjoyable and fulfilling. Senator Barack Obama is welcome to come again to learn more about the country, the Government and the people of this country.

Mr. Berg,

I heard you on 105.7 in Baltimore yesterday and must say I am intrigued and believe you may really be on to something! The stall tactics of Obama and DNC lawyers give every indication that you may very well be correct in your research and assessment of the situation. I would like to suggest that perhaps you post on the main page of the website the reasons the case is costing you so much and why you need the money, rather than just a call for the money. If you did so I believe more people would be inclined to help.

Likewise you will doubtless face a great deal of criticism from Obama supporters who would refuse to even consider the possibility that he may not be natural born. Asking for money without clarifying why, could be used against you in the court of public opinion.

If you wish to keep your credibility I would also suggest a disclosure of how much money has been donated and what it is paying for, also be posted to the website. I believe in your cause and that the constitution should always be adhered to no matter what the mob mentality may dictate. I want to donate but also would like to have some assurances as to the reasons for the request for funds and how they are being used.

I believe Mr.Berg is doing this as Pro bono, which means he doen't get paid. That Pro bono means.
I worked in the legal field in the past. I participated in many law suits. Law suits cost a lot.
On average, decent law suits at a big law firm cost more than a few million.
While Mr.Berg works pro bono, who is going to pay his bills and costs? As we can see, he seems to be working very hard motions after motions. I believe he needs some financial assistance. If we donate enough, he can get many experts opinions/or hire them as in his pay role, if needed. He will have more resorces and time. He can hire more lawyers to help him, hire investigatores here in the US or overseas, etc., etc. Yes, money can do a lot of things. And everything costs money. I hope he wins.

This will probably never get posted, but this legal challenge is so ridiculous. In fact, John McCain's eligibility to be President as a natural born citizen is more contested than Obama's. If anyone here is interested in the truth, you can visit www.snopes.com and find out.

What Mr. Berg is NOT telling all of you who are giving him money is that the constitutional text he is basing his case on ONLY applies to persons born OUTSIDE OF THE UNITED STATES. Mr. Obama was born in Hawaii in 1961. Hawaii became a US state in 1959; therefore, he was born in America.

I worry that the real interest in Mr. Berg's case is based in simple racism, but only you all know if you're racist or not.

I guess you could say that Phil is doing it pro bono, but he's not representing a client. He is the actual plaintiff in the case and is representing himself. I don't know whether that actually meets the definition of pro bono.

Obama is the leading candidate for President of the United States with less than a month left before the popular election. This lawsuit seeks to destroy his political career based on what might be unprovable facts. How could you not expect his lawyers to delay this lawsuit as much as possible? They will continue to do so, even years into his presidency if necessary. Obama is doing the right thing for himself in his response, so don't anybody get upset about the motion to dismiss and be prepared for a general denial of the entire complaint if and when he is required to answer. The lawsuit's complaint is just a statement of allegations, for which the plaintiff needs strong proof before any relief can be granted, why would Obama's attorneys want to supply a document creating a question of fact that a trial would need to decide, unless he had no alternative?

Surely, Obama is not going to supply you with any documents to be scrutinized unless and until he is finally required to do so. And even then, you know it will be the credibility of a Hawaii birth certificate vs. a dubious Kenya birth certificate that will be the subject to that scrutiny (plus the marriage certificate of his parents will also be necessary at some point, as there are different residency requirements to transmit citizenship to a child, depending on whether the mother was in wedlock at the time of birth or not). Loss of citizenship to Indonesia that was not willful on Obama's part will be even more difficult to prove; all he has to say is that he was a child.

Ultimately, I think this lawsuit is doomed to certain failure, because even if the allegations are true and he was born in Kenya, acceptable and admissible evidence to prove this fact may be impossible to get now. Whatsmore, the complaint is silent as to when and how Obama originally entered the U.S. as a U.S. citizen, given that U.S. passports were is general use for international travel in 1961 and the Dept. of State Bureau or Consular Affairs is and was the agency responsible for adjudicating all citizenship claims and issuing/amending all U.S. passports.

In case you missed it, the whole country is getting for massive civil unrest no matter what happens. If Obama is disqualified or loses on Nov. 4th, there will more than likely be riots. If he wins on Nov 4th. his "followers" will turn a "celebration" into a riot.

I doubt it. To get a judge not appointed by Clinton or one of the Bushes, you'd have to get someone who was appointed over 20 years ago and wasn't moved up to the appellate courts. Then before that, you had a Republican for the previous 8 years.

Petitions will NOT help, and could possibly damage Mr. Berg's case. The judge has to make his ruling(s) according to applicable law, not public opinion, petitions, etc. I'm sure the judge knows any ruling(s) he makes will be under scrutiny by a higher court if an appeal is filed. He's probably taking his time researching case law to make sure he makes the right decision(s). Also, he has other cases on his docket. He can't put the other cases on hold just for this one case Mr. Berg has filed. All we can do is wait......and pray.

The courts did not dismiss the case. The point is how far will Barack Obama go to conceal his records and why? He has admitted to cocaine and marijuana use which are illegal. He has admitted by his own words he sought heroin - though changed his mind. We know that Ayers launched Obama's career in his livingroom. The question for me is, what beyond his admitted information is he fighting so hard to conceal? We already know McCain graduated 5th from the bottom of his class and that Sara Palin changed colleges 6 times so what is Barack afraid of? Has the electoral college met and cast their votes?

If so, has congress accepted the electoral college vote?

If so, has he been sworn in?

What is now happening in this "constitutional crisis" case reminds me of an Arlo Guthrie song entitled; "Alice's Restrurant"

Remember when the deputy sheriff (Obby) took all those 12x10 color glossy photos of the scene of the crime (littering) to be used as evidence at the trial. The deputy took hundreds of pictures detailing the crime in detail......only to get to the court and...

In walks the judge with his seeing eye dog. The judge sits down, the seeing eye dog sits down, then the deputy comes to the realization that he was caught in a situation where the judge wasn't going to look at those hundreds of 12x10 color photos of the crime scene and all those things. For 18 minutes, Arlo Guthrie, remember him, (the singer) raves on, but in the end it was just another case of American Blind Justice.

I think we have a similar situation with this case against obama. It has now been 56 days since Mr. Berg acting alone filed his case in Federal Court. Mr. Berg has responded promptly to all rebuttals made by obama's Arab lawyer. But to date, this federal judge has not responded PERIOD.

My question is simple: How long does it take this judge to read and research the cited cases by Mr. Berg and obama's Arab lawyer? Surely he has assistance to help in that area. Surely the judge is aware of the time factor here.

I fear the judge has been bought off like all other opposition against obama and we won't get an answer before election day! Just another case of American Blind Justice!

That is if the election is held before the suit gets through and Obama wins....then the suit goes through and Obama is indeed not a citizen, it is said that Biden will then get the Presidency seat. We all feel that this shouldn't be. If Obama knew he was committing a crime run for the office of the President without legally being a citizen, could the Republican party demand a new election?

I'm not going to take the time to actually answer you directly, but the below is a comment that I posted (while half asleep) to a somewhat similar question:

You are right, to an extent, however, I think there would still be a constitutional crisis.

Remember, if Obama gets elected on Nov. 4 and then is disqualified before the electoral college votes, the electoral college would still be required to vote. Who do they vote for? Several possibilities present themselves:

1. They say we were elected to vote for Obama so we're going to do it because that's what the people wanted so forget the minor detail in the constitution. This = constitutional crisis.

2. They should then vote for McCain who received the second largest number of votes, but they were pledged to vote for Obama, a Democrat. Do they vote for the Republican who received less votes than Obama or do they vote for Biden because he was the VP nominee who couldn't pull his own party's votes in the primaries? Either way = constitutional crisis.

Next you have the situation where the electoral college has voted before he's disqualified but before congress certifies the vote. Congress can then do any of the following:

1. Certify Obama because that's what the people wanted so forget the minor detail in the constitution. This = constitutional crisis.

2. Vote for and certify McCain who received the second largest number of votes, but they the people voted for Obama, a Democrat or do they vote for and certify Biden because he was the VP nominee who couldn't pull his own party's votes in the primaries? Either way = constitutional crisis.

3. Elect and certify someone else, perhaps Hillary, or Pelosi, or Reid. Close to half the people voted for McCain - does a Democratic congress seat a Democrat instead? = constitutional crisis.

Obama is sworn in before he's disqualified:

1. The Supreme Court removes him because he wasn't eligible to begin with and therefore wasn't really the POTUS = Constitutional crisis between the Supreme Court and Congress.

2. Democratic congress refuses to impeach a Democrat = constitutional crisis.

3. Congress impeaches him and Biden becomes president. If Obama wasn't a legitimate president then Biden wasn't legitimately elected as VP. Constitutional crisis.

Something else enters into the equation. The constitution is supposed to be interpreted according to what the framers had in mind. The framers originally had the party receiving the second highest electoral vote becoming the VP and provided that if the president elect wasn't able to serve then the VP elect would serve until congress elected a president. Later on, the constitution was amended to have the presidential and VP nominees run together so that the president and VP wouldn't be political enemies. I think this might even become a constitutional crisis.

Note: I should proofread this long post, but I'm too tired, so I'll have to hope I didn't make any glaring errors and that the whole thing is understandable. But, I think you get the general idea of why this must be decided before the election.

I have checked your website (obamacrimes) to seek a status on this matter, but have not seen an update that indicates where the matter now stands in the court system. According to a recent article (dated today) on an internet publication, this issue in now in the hands of “Judge R. Barclay Surrick, who was appointed to the Third Circuit by President Bill Clinton in April 2000”. In yet another recent publication (dated 10 Oct) the case is allegedly in the hands of a US District Court in Pennsylvania. I thought that a court had already ruled against a motion to dismiss and had issued an order to disclose the information that you seek within three days. Please provide an update on where this now stands.

As I reviewed the Illuminati video clip on YouTube, I noted other clips that supported your position - - to include a credible analysis/inspection of the birth certificate posted to the Obama website that suggests the posted certificate as a possible forgery. The case is in the hands of a US District Court in Pennsylvania and is in the hands of “Judge R. Barclay Surrick, who was appointed to the Third Circuit by President Bill Clinton in April 2000”. The US District Court for the Eastern District of PA is a part of the Third Circuit and Judge Surrick is the judge presiding over the case.

As of this time, the ONLY ruling the Handed down by the Court was a denial of a temporary restraining order to keep the DNC from nominating Obama. Everything else still awaits the Judge's ruling.

Well we can give lots of reasons why Obama would withhold infomation. Most of them have to do with affiliations. But lets say that there is nothing behind this birth certificate as his supports believe. I'm kind of confused about all this, so maybe someone can help.
#1 It is undisputed that Obama's mother has been a U.S. Citizen all along.
#2 Since his mother is a citizen, it doesn't matter where he was born-- same as the story with McCain being born in Panama . . . right?
#3 Even if Obama's stepfather obtained Indonesian citizenship on behalf of Obama when he was a child, how does that affect Obama's U.S. citizenship? Per the U.S. State Dept. website "In order to lose U.S. citizenship, the law requires that the person must apply for the foreign citizenship voluntarily, by free choice, and with the intention to give up U.S. citizenship." How could a six-year-old child possibly renounce his citizenship intentionally? If memory serves, a six-year-old isn't even considered to have sufficient understanding to criminally prosecuted in most states! And apparently when he arrived in Indonesia he went to school, so it must have been a fait accompli. I'm hoping Mr. Berg can explain this, because I don't understand it.

I just called FOX and asked the question about this particular lawsuit and was told that the reason there is nothing being reported on it is because there is no basis for the lawsuit. Mr. Berg is the same gentleman who brought about the lawsuit against Bush/Chaney for the war in Iraq...which was frivolous. Well they feel the same way about this. The reason they feel this way is because if in fact he was born to a US Citizen in Hawaii then he by RIGHTS under our constitution is in fact a citizen.

I called the office of the Texas Secretary of State, elections
division, at 9:30am Oct 21, 2008. After a 4 minute
hold, I spoke to a representative. I asked the question, "What Texas
agency certifies that presidential candidates meet the requirements of
Article 2 of the US Constitution?"

The representative was very straightforward: "No government agency
certifies a presidential candidate under the requirements of the US
Constitution. If the candidate says they meet the requirements, they
we accept the candidate. If there is a challenge to the candidate's
eligibility, it can only be resolved by a lawsuit, such as Berg v
Obama in Pennsylvania."

So even though over 200 million US voters assume that the government
must have checked the eligibility of the presidential candidates, the
official answer is that our government believes THEY ARE NOT
RESPONSIBLE FOR ENFORCING ARTICLE 2 OF THE US CONSTITUTION. What is
also fascinating is that the Texas Secretary of State is FULLY AWARE
THAT A PRESIDENTIAL CANDIDATE MIGHT NOT BE ELIGIBLE.

This explains the reason for the lawsuit in Washington state against
the Washington Secretary of State, trying to force the secretary to
take responsibility for vetting presidential candidate eligibility.

In Berg v Obama filed in Philadelphia in August 21, 2008, Berg alleges
that Barack Obama:

1. Was born in Kenya, making him ineligible to be President.
2. Was a citizen of Indonesia, which means that if Barack Obama is
a US citizen, he was Naturalized and therefore not eligible to be
President.
3. While a citizen of Indonesia his legal name was Barry Soetoro
and may still be today, which means that the name on the ballot might
be wrong.
4. Has posted an electronically forged image of a Hawaii
Certificate of Live Birth on his campaign web site.

To date, instead of offering documentation to disprove the
allegations, as Obama easily should be able to do, Obama has moved to
dismiss the case on technicalities.

If any of the Berg allegations are true, or if Obama has in any way
hidden key facts about his past as they relate to his eligibility,
then your office would be complicit in massive disenfranchisement of
voters. The burden of proof of eligibility rests on the candidate,
and it appears that Obama has declared himself ineligible to be on a
Texas ballot by his refusal to provide proof of eligibility required
by the US Constitution.

My suggestion to everyone:
1. Call your secretary of state. Each states's SoS is responsible for following election laws.
2. Ask "What government agency certifies that the candidates for president are eligible under Article 2 of the US Constitution?" (Article 2 contains the requirement that a President must be a "natural born citizen")
3. Post the answer they give you, here.
4. Send that answer to everyone you know, because everyone assumes that Obama must be eligible because he is on the ballot. Challenge your friends and relatives to call the SOS themselves. Your email to your friends and relatives will carry more weight if you got the answer yourself, because everyone is skeptical of something passed around the internet.

It's easy to explain how Obama has all the documents to function in US society.
1. If you're a naturalized citizen, you can get a passport, drivers license, social security card, etc, with a naturalization certificate. In Obama's case, he could be a naturalized citizen.
2. If you were born outside of a hospital (at home, in a train/plane/car, etc) your parents could have applied for a birth registration, certifying that they witnessed your birth. In Obama's case, he could have been born outside the US and his mother could have filed a birth registration and lied about the location.
3. You can buy all the documents you need on the black market. Anyone with enough money can get valid US documentation (not forgeries - real documents) for the right price. Corruptible humans work in every government agency. Obama is well connected to money sources. In some countries, this is the only way to get documentation quickly.
4. You can buy forgeries. Obama is obviously comfortable with forged documents, although he didn't pay enough for the birth certificate image on his web site.

This confirms that Obama's stepfather is Lolo Soetoro, the second
husband of Ann Durham, Obama's mother. Lolo Soetoro was an Indonesian

citizen. Obama is therefore a naturalized US citizen, and ineligible
to be a US President. While Obama was an Indonesian citizen, his name
was Barry Soetoro. He may have changed his name when he was
naturalized.

I suggest securing the hospitals and their records section so that no one from the Obama camp can access and create any fictious account or record indicating that he was born there.

This may be very amateur, however, just comparing birth certificates from the early 50's and 70's, Obama's alleged certificate is very suspect. Birth certificates were lined as typewriters were the only method of recording, yet O's certificate looks very recent.

Just a thought. This man has so many skeletons in his closet it is hard to keep count.

I'm disappointed to see that you are asking for money without telling us how much money you need to raise and how much you have raised so far. Perhaps you could post a graph, such as a fundraising thermometer, that would give us a better picture of your financial needs.

Phil isn't sure. It depends on too many variables. If this judge doesn't rule in our favor, it is VERY expensive to go to the Supreme Court. Phil may need expert testimony and that is very, very expensive. People are hurting financially.

Phil needed a trusted webmaster (who cut his rates dramatically, but he has to live, too) to keep this site up and running smoothly and believe me, there have been wrinkles due to the high traffic and efforts to hack this site - which have been UNSUCCESSFUL! NO ONE in Phil's office is getting paid for their time or effort. Not me for all my research before I took the case to Phil, not his Assistant or legal team, or himself either. There is the Private invetigator who has helped check our research. The domain and webhosting itself cost something. Now there are International calls going back and forth with API in Norway. Phil has had a huge jump in cell phone usage to be available for interviews when he's traveling back and forth to courts, etc.

Believe me, everything about the costs for this case has been cut to the bone. The only possible "fat" has been related to the cell phone because Phil has to be able to talk to media for interviews and he can't stay chained to his desk. There are court costs to file the suit and for repeated service of documents. Phil has had to pay twice for service to the State Department. The AG of Hawaii has refused to honor the federal subpeonas to the Department of Health and the two hospitals. Out of state service isn't free either and then Phil had the service to Obama's Senate office, the DNC, the Senate Rules Committee, Feinstein, the FEC, the SoS of PA and the PA elections comissions.

If Phil has to go to the Supreme Court to appeal or push expeditied rulings because this judge won't act, even those requirements for special indexes, special papers, special tabs and special bindings, plus there has to be multiple originals, not photocopies for each judge and all the oppositional representative/s of the defendents. All of the costs of the special requirements to file in the Supreme Court mount real quick.

I could do a lot to help Phil in his office, but I'm in Texas. I've worked for law firms and I know litigation is expensive even if you're just covering the costs. Have you ever sued anyone or been sued? Much less taken it to the Supreme Court? And that's just what comes to me off the top of my head.

I can absolutley tell you his Assistant Lisa has worked 16 to 18 hours of EVERY DAY, into the wee hours of every night with Phil to get responses out and research case law at the Supreme Court Law Library and online. She has had ONE AFTERNOON OFF on Oct 12 since around the end of July when we began researching this case. She isn't getting paid for that unless some miracle happens that we can't imagine. Like I said, everyone has donated their time. Phil & Lisa have spent every waking minute working on this except for Phil's other clients. To protect the integrity of the tapes and make sure they became available and API was not victimized for doing the right thing, he's representing them to facilitate their release.

It's amazing, I got on a left wing chat (thomhartman.com) and these people had no clue and just called me a troll just for offering this information. The tape is less than an hour. That’s new news for you all. I can validate that the tapes arrived 2 hours ago plus which would be about 4-6pm EST. I was not able to get how or where when asked. His lawyer has restrictions on what he can and can’t say and how I can talk about this to others.

He is a gentleman and a caring and considerate man based on our discussions concerning his site. His language is definitely not American. His terminology was such that I had to verify what he was saying and express them in my terms so he could agree.

We could not discuss anything about the tape content. I understand and did NOT force the issue.

He is concerned about the abuse between the visitors on this site and wishes that folks would treat each other better.

He is confident about this issue and therefore isn’t necessarily concerned about the doubters. Also, he absolutely doesn’t want censorship on this site.

There is a contract/deal in place with a media source. I was not given the details of that. I don’t think that he will mind me telling you that the eagle has landed.

From what I can understand and perceive from the CIA contact story, he is comfortable with CIA folks. That’s all I can remark about that.

I will be at a meeting for a couple of hours and will not be able to respond if you ask a question until I return.
