Phil J. Berg filed an amended complaint today in Berg v. Obama. The amended complaint adds the Pennsylvania Department of State, the Secretary of the Commonwealth Pedro A. Cortes (in his official capacity), the U. S. Sentate Committee on Rules and Administration, and Senator Diane Feinstein (in her official capacity as chairman) for their failure to exercise due diligence with respect to Barack Obama's contitutional qualifications to be elected and serve as President of The United States, and for his inclusion on the ballot in Pennsylvania as a candidate for President of the United States.
The amended complaint also bolsters the standing argument and adds additional relevent facts.
Essentially, the argument is this:
- Senator Obama could put this whole issue to rest by providing an official "vault copy" birth certificate.
- Senator Obama has chosen not to do so.
- The defendants (other than Obama) have a responsibility to protect the integrity of the electoral system by properly vetting the qualifications of candidates, which they have failed to perform.
- Mr. Berg, other Americans, and our system of government are damaged by this failure.
- Senator Obama, who has collected $425,000,000 in campaign contributions, has perpetrated a fraud.
Following are some of the factual statements made in the amended complaint (The complete complaint is attached below):
36. Obama is a representative of the Democratic People. However, Obama must meet the Qualifications specified for the United States Office of the President, which he must be a “natural born” citizen. Additionally, Obama must be at least a “naturalized” citizen to hold his Office of U.S. Senator for Illinois. Unfortunately, Obama is not a “natural born” citizen, nor is he a “naturalized” citizen. Just to name one of the problems, Obama lost his U.S. citizenship when his mother married an Indonesian citizen, Lolo Soetoro who legally “acknowledged” Obama as his son in Indonesia and/or “adopted” Obama, which caused Obama to become a “natural” Indonesian citizen. Stanley Ann Dunham Soetoro relocated herself and Obama to Indonesia wherein Obama’s mother naturalized in Indonesia. This is proven by Obama’s school record with the student’s name as “Barry Soetoro”, Father’s name: Lolo Soetoro, M.A., and Citizenship: Indonesia.
37. There appears to be no question that Defendant Obama’s mother, Stanley Ann Dunham, was a U.S. citizen. It is also undisputed, however, that his father, Barack Obama, Sr., was a citizen of Kenya. Obama’s parents, according to divorce records, were married on or about February 2, 1961.
38. Defendant Obama claims he was born in Honolulu, Hawaii on August 4, 1961 and it is uncertain in which hospital he claims to have been born. Obama’s grandmother on his father’s side, his half-brother and half-sister all claim Obama was born not in Hawaii but in Kenya. Reports reflect that Obama’s mother traveled to Kenya during her pregnancy; however, she was prevented from boarding a flight from Kenya to Hawaii at her late stage of pregnancy (which, apparently, was a normal restriction, to avoid births during a flight). By these reports, Stanley Ann Dunham Obama gave birth to Obama in Kenya, after which she flew home and registered Obama’s birth. There are records of a “registry of birth” for Obama, on or about August 8, 1961 in the public records office in Hawaii.
39. Upon investigation into the alleged birth of Obama in Honolulu, Hawaii, Obama’s birth is reported as occurring at two (2) separate hospitals, Kapiolani Hospital and Queens Hospital. The Rainbow Edition News Letter, November 2004 Edition, published by the Education Laboratory School did a several page article of an interview with Obama and his half-sister, Maya. The Rainbow Edition News Letter reports Obama was born August 4, 1961 at Queens Medical Center in Honolulu, Hawaii. More interesting in February 2008, Obama’s half-sister, Maya, was again interviewed in the Star Bulletin, and this time, Maya states Obama was born August 4, 1961 in Kapi’olani Medical Center for Women & Children.
40. Plaintiff is informed, believes and thereon alleges a research team went to Mombassa, Kenya, and located a Certificate Registering the birth of Barack Obama, Jr. to his father, a Kenyan citizen and his mother, a U.S. citizen.
41. Even if Obama was, in fact, born in Hawaii, he lost his U.S. citizenship when his mother re-married and moved to Indonesia with her Indonesian husband. In or about 1965, when Obama was approximately four (4) years old, his mother, Stanley Ann Dunham, married Lolo Soetoro, a citizen of Indonesia, whom she had met at the Hawaii University, and moved to Indonesia with Obama. Obama lost his U.S. citizenship, when his mother married Lolo Soetoro, and took up citizenship of and residency in Indonesia. Loss of citizenship, in these circumstances, under U.S. law (as in effect in 1965) required that foreign citizenship be achieved through “application.” Such type of naturalization occurred, for example, when a person acquired a foreign nationality by marriage to a national of that country. Nationality Act of 1940, Section 317(b). A minor child follows the naturalization and citizenship status of their custodial parent. A further issue is presented that Obama’s Indonesian stepfather, Lolo Soetoro, either signed an acknowledgement acknowledging Obama as his son or Lolo Soetoro adopted Obama, giving Obama natural Indonesia citizenship which explains the name Barry Soetoro and his citizenship listed as Indonesian.
42. Obama admits in his book, “Dreams from my father” Obama’s memoir (autobiography), that after his mother and Lolo Soetoro were married, Lolo Soetoro left Hawaii rather suddenly and Obama and his mother spent months in preparation for their move to Indonesia. Obama admits when he arrived in Indonesia he had already been enrolled in an Indonesia school and his relatives were waiting to meet him and his mother. Lolo Soetoro, an Indonesian State citizen, could not have enrolled Obama in school unless Lolo Soetoro signed an acknowledgement acknowledging Obama as his son, which had to be filed with the Government. Under Indonesian law, when a male acknowledges a child as his son, it deems the son, in this case Obama, as an Indonesian State citizen. Constitution of Republic of Indonesia, Law No. 62 of 1958 Law No. 12 of 2006 dated 1 Aug. 2006 concerning Citizenship of Republic of Indonesia, Law No. 9 of 1992 dated 31 Mar. 1992 concerning Immigration Affairs and Indonesian Civil Code (Kitab Undang-undang Hukum Perdata) (KUHPer) (Burgerlijk Wetboek voor Indonesie) states in pertinent part, State citizens of Indonesia include: (viii) children who are born outside of legal marriage from foreign State citizen mother who are acknowledged by father who is Indonesian State citizen as his children and that acknowledgment is made prior to children reaching 18 years of age or prior to marriage; Republic of Indonesia Constitution 1945, As amended by the First Amendment of 1999, the Second Amendment of 2000, the Third Amendment of 2001 and the Fourth Amendment of 2002, Chapter X, Citizens and Residents, Article 26 states, “(1) Citizens shall consist of indigenous Indonesian peoples and persons of foreign origin who have been legalized [sic] as citizens in accordance with law. (2) Residents shall consist of Indonesian citizens and foreign nationals living in Indonesia.”
43. Furthermore, under the Indonesian adoption law, once adopted by an Indonesian citizen, the adoption severs the child’s relationship to the birth parents, and the adopted child is given the same status as a natural child, Indonesian Constitution, Article 2. Thus, where Obama was actually born and what his mother’s citizenship status at the time of this birth is irrelevant.
44. The laws in Indonesia at the time of Obama’s arrival did not allow dual citizenship. If an Indonesian citizen married a foreigner, as in this case, Obama’s mother was required to renounce her U.S. citizenship and was sponsored by her Indonesian spouse. During this time, Indonesia was a Police State. The public schools did not allow foreign students, only citizens were allowed to attend as Indonesia was under strict rule and decreed a number of restrictions; therefore, in order for Obama to have attended school in Jakarta, which he did, he had to be a citizen of Indonesia, as the citizenship status of enrolled students was verified with Government records.
45. Obama was enrolled by his parents in a public school, Fransiskus Assisi School, a public school, in Jakarta, Indonesia. Plaintiff has received copies of the school registration in which it clearly states Obama’s name as “Barry Soetoro,” and lists his citizenship as Indonesian. Obama’s father is listed as Lolo Soetoro, Obama’s date of birth and place of birth are listed as August 4, 1961 in Hawaii, and Obama’s Religion is listed as Islam. This document was verified by Inside Edition, whose reporter, Matt Meagher, took the actual footage of the school record. At the time Obama was registered the public schools obtained and verified the citizenship status and name of the student through the Indonesian Government. All Indonesian students were required to carry government identity cards, or Karty Tanda Pendudaks, as well as family card identification called a Kartu Keluarga. The Kartu Keluarga is a family card which bears the legal names and citizenship status of all family members.
46. Since Obama’s birth was legally acknowledged by Lolo Soetoro, an Indonesian citizen, and/or Obama was adopted by Lolo Soetoro, which the evidence supports, Obama became an Indonesian citizen and bears the status as an Indonesia natural child (natural-born). For this reason, Obama would have been required to file applications with the U. S. State Department and follow the legal procedures to become a naturalized citizen in the United States, when he returned from Indonesia. If Obama and/or his family failed to follow these procedures, then Obama is an illegal alien.
47. Regardless of whether Obama was officially adopted, (which required a Court process), by his Indonesian stepfather, Lolo Soetoro, or his birth was acknowledged (which only required the signing of a governmental birth acknowledgement form), by Lolo Soetoro, one of which had to occur in order for Obama to have the name Barry Soetoro and his citizenship status listed as “Indonesian”, in either and/or both cases Obama’s name was required to be changed to the Indonesian father’s name, and Obama became a natural citizen of Indonesia. This is proven by the school records in Jakarta, Indonesia showing Obama’s name as Barry Soetoro and his citizenship as Indonesian. Again, the registration of a child in the public schools in Jakarta, Indonesia was verified with the Government Records on file with the Governmental Agencies.
48. The Indonesian citizenship law was designed to prevent apatride (stateless) or bipatride (dual citizenship). Indonesian regulations recognize neither apatride nor bipatride citizenship.
49. In addition, since Indonesia did not allow dual citizenship neither did the United States, Hague Convention of 1930.
50. In or about 1971, Obama’s mother sent Obama back to Hawaii. Obama was ten (10) years of age upon his return to Hawaii.
51. As a result of Obama’s Indonesia “natural” citizenship status, there is absolutely no way Obama could have ever regained U.S. “natural born” status, if he in fact ever held such. Obama could have only become naturalized if the proper paperwork was filed with the U.S. State Department, in which case, Obama would have received a Certification of Citizenship.
52. Plaintiff is informed, believes and thereon alleges Obama was never naturalized in the United States after his return. Obama was ten (10) years old when he returned to Hawaii to live with his grandparents. Obama’s mother did not return with him, and therefore, unable to apply for citizenship of Obama in the United States. If citizenship of Obama had ever been applied for, Obama would have a Certification of Citizenship.
53. Furthermore, Obama traveled to Indonesia, Pakistan and Southern India in 1981. The relations between Pakistan and India were extremely tense and Pakistan was in turmoil and under martial law. The country was filled with Afghan refugees; and Pakistan's Islamist-leaning Interservices Intelligence Agency (ISI) had begun to provide arms to the Afghan mujahideen and to assist the process of recruiting radicalized Muslim men--jihadists--from around the world to fight against the Soviet Union. Pakistan was so dangerous that it was on the State Department's travel ban list for US Citizens. Non-Muslim visitors were not welcome unless sponsored by their embassy for official business. A Muslim citizen of Indonesia traveling on an Indonesian passport would have success entering Indonesia, Pakistan and India. Therefore, it is believed Obama traveled on his Indonesian passport entering the Countries. Indonesian passports require renewal every five (5) years. At the time of Obama’s travels to Indonesia, Pakistan and India, Obama was twenty (20) years old. If Obama would have been a U.S. citizen, which he was not, 8 USC §1481(a)(2) provides loss of nationality by native born citizens upon "taking an oath or making an affirmation or other formal declaration of allegiance to a foreign state...after having attained the age of eighteen years”, in violation of 8 U.S.C. §1401(a)(1). Since Lolo Soetoro legally acknowledged Obama as his son and/or adopted Obama, Obama was a “natural” citizen of Indonesia, as proven by Obama’s school record.
54. Plaintiff is informed, believes and thereon alleges Obama stated his citizenship as a “Kenya Citizen” when he applied for and was accepted at Columbia University. Obama has refused to release any records from Occidental College, Columbia University, Harvard Law School and any of his medical records.
55. Plaintiffs as well as many other democratic American citizens have requested proof of Obama’s citizenship status, however to no avail. Obama has promised to be an open and honest candidate, however, refuses to remove any doubts from Plaintiff’s and all the other democratic minds and prove his eligibility to serve as President of the United States.
56. Plaintiff’s civil rights under the due process rights and equal protection of the laws secured by the U.S. Constitution, Fourteenth (14 ) Amendment th have been violated by Obama’s illegal campaign and will continue to be violated if Obama is allowed to continue his campaign and if elected, assume the position of President of the United States. The DNC and FEC have allowed Obama to continue his campaigning, knowing these issues have arisen and have failed to take and/or instigate the proper investigation into said matters to protect Plaintiff and other registered voters. Therefore, the only option Plaintiff had to secure and protect his civil rights was to bring action before this Honorable Court. Moreover, our laws which protect Plaintiff, a legal registered voter, and other registered voters from fraudulent campaign schemes have been violated by the Defendants, 2 U.S.C. §437c, 2 U.S.C §437(g). Plaintiff has standing to bring suit pursuant to 5 U.S. C §702, as well as 8 U.S. C §1481(b).
57. Plaintiff’s rights guaranteed under the Liberty clause of the Fourteenth (14th) Amendment of the United States Constitution have already been violated. It has been announced in the main stream media that Obama’s “briefing” has already begun into our National Secrets, our Nations Top Secrets, which Obama is not privy too and in violation of our National Security, as Obama is not a legal citizen of the United States. This has placed Plaintiff and other citizens of the United States in grave danger. Plaintiff’s Liberty as guaranteed will further be violated if Obama is allowed to be voted into and assume the position of President of the United States; Plaintiff will be further damaged and is in serious jeopardy.
58. Plaintiff filed the within action on or about August 21, 2008 against Defendants seeking Declaratory and Injunctive Relief, declaring Obama an illegal alien and/or only a “naturalized” citizen ineligible to serve as President of the United States and enjoining the PA Department of State, Bureau of Commissions, Elections and Legislation, the DNC and FEC from placing Obama’s name on the ballot and prohibiting Obama from further campaigning to be elected as President of the United States, a position he is ineligible to hold.
59. Plaintiff faxed a copy of the original complaint to Obama, the DNC and FEC on August 22, 2008 prior to the hearing on the TRO before this Honorable Court. Defendants were further served by personal service on September 4, 2008. Neither the DNC nor Obama have supplied any type of proof of Obama’s citizenship status and/or eligibility to serve as President of the United States.
60. Plaintiff has asked for a simple resolution. Plaintiff has asked that Obama supply a genuine certified copy of his original long version “vault” Birth Certificate, A Certification of Citizenship and a certified copy of his Oath of Allegiance. If in fact Obama can prove his “natural born” citizenship status, which he cannot, then he has not been prejudiced in anyway, but instead Plaintiff has been protected and his civil rights secured. However, if Obama is unable to supply said documentation, then he needs to withdraw his candidacy, again which will eliminate Plaintiff’s deprivations and instill Plaintiff’s constitutionally protected safeguards and rights.

If in fact this lawsuit is true then why is it that no one knows about obama not being a natural born citizen and more importantly if it was really true McCain and Palin would be tearing him apart with the use of this information.

I'm torn. Every time Mr Berg amends his complaint the case gets more and more heinous and looks (to me) even more and more "can't lose", but time is running out. Things are going to get very, very messy if the judge doesn't make a decision before November, Inauguration Day at the LATEST. And that's pretty darn late...

There seems to be some sort of "plan" for Obama to be come president. The same thing happened 8 years ago with W. He was "elected". It seemed like the media and everyone else was doing what they could to put him in to the oval office. Seems like history is just repeating itself. The media is so totally into Obama it's ridiculous. Obama has brainwashed too many people. It's such a shame that Howard Dean's hatetred for the Clintons has put us in this situation. It a sad state of affairs for America that it's citizens can't seem to get past his white teeth and his "Micheal Jackson" looks and see the distaste that Obama and his wife has for whites. If he is indeed elected, it will set back race relations back in this county 100 years.
I'm sure someone has pointed this lawsuit out to the GOP. It would be in their best interest to back it. I can only hope that they know something that we all don't and will say something sooner rather than later. People are already starting to Vote, so at some point it's going to be too late. Come on Obama, if you are truely who you say you are, then come out with the documents requested with out delay.

The better question is, if Obama is a citizen of America, he has had plenty of time to produce the needed documents to lay this issue to rest. For what reason would he not? He is running for the top job, the moet important job in America. Is it too much to ask of him as was asked of McCain, that he prove his citizenship? Any American in the same position would rush to meet the request of those whose vote they would hope to obtain.

I anticipated Mr. Berg's claim of standing as a ranking Democrat and officer of the court sworn to uphold the Constitution.
However, parties with even more standing are Secretaries of State who are responsible for electoral oversight. Where are the 'Red' state Republicans on this?

The reason you are not hearing Republicans about this issue is that it more than likely would cause a Hillary/McCain election, which they know they cannot win. Wait till it gets closer to the election and you will hear them talk about this. When there is little time and the Democratic party will be in mass confusion

Anyhow, democrats have created such a smelly doo doo that there is no safe way out of it.
Just hope this will not end up like with his cousin Odinga, calling for revange and street fights.
People that think this should be delayed further, may be responsible at the end for terrible consequences.

If this issue gets big, which a highly hope it does, the media will try to do everything in thier power to not let the public know about this. Hopefully, the judge will make his decision soon. We have to put an end to this abomination that is Obama. Mr. Berg you are a good man, fighting for a just cause, I hope only the best.
By the way, I heard you speak on the Bill Cuningham show (or was it Mark Lavinn?), anyway, best of luck, hope this gets out to more of the public.

Howard Dean, the DNC Chair, is the main idiot here. IT IS HIS RESPONSIBILITY TO ENSURE THAT THE DEMOCRATIC PRESIDENTIAL CANDIDATE IS QUALIFIED TO RUN FOR AND HOLD THE OFFICE OF POTUS.
I registered as a Democrat to vote in New Mexico Democratic Caucus in 2004. When moveon.org published the full page ad against the Nation's finest General, David Petraeus, I then changed my party registration to Republican as a form of protest.
Because of Howard Dean's failure to uphold the US Constitution, I will probably never ever again register as a Democrat. I believe the Court needs to be informed of how angry this voter is.

In Berg's defense of the Motion to Dismiss he included the Order that he wanted the Judge so sigh for production. It was for 3 THREE documents.
ORDERED that the Motion to Dismiss pursuant to F.R.C.P. 12(b)(1) and
12(b)(6) is DENIED. It is further ORDER of this Court that the following discovery is
to be turned over to Plaintiff within three (3) days:
1. Obama’s “vault” version (certified copy of his “original” long version)
Birth Certificate; and
2. A certified copy of Obama’s Certification of Citizenship;
3. A Certified copy of Obama’s Oath of Allegiance.
Now if you are telling the that is just too difficult then I don't follow your logic.
So, once again, the filing today makes little sense unless you are fearful of the Judge ruling to continue with discovery while not ruling on the Motion to dismiss.
It has little to do with the original filing at this point. The Judge can simply sign Berg's Order requesting the three documents and hold off on the Motion to dismiss, or he can rule for Berg and discovery will go forward or he can rule for Obama and the case is dismissed. I'm also certain he can make another ruling to go forward with some discovery different from the three items Berg had requested.
The DNC and Obama motion today would only be relevant if some form of discovery is to go forward and the motion to dismiss ruling is withheld. So it is very limited and tells me there is a fear from the Obama/DNC side that discovery will be going forward.

Actually, the discovery goes MUCH further than thos e 3 items.
Berg sent interogitories (sp?) containing a great number of questions to be answered by both Obama and the DNC. The questions can be seen if you download and read the exhibit included with Obama's and the DNC's filing.
Still, if they would supply the only those 3 items, it might defuse the entire case.

I agree. Mr. Berg has said that if those three items are produced he would end the lawsuit. I don't, for one minute, think Obama can produce any of them. If he did I would be satisfied and could move on. Still wouldn't care for him but it would allow me to be satisfied that he is costitutionally qualified to even be in the race.
Mr. Berg began with the shotgun approach and has boiled it down to those three documents. I mean he even had the Dudley Dooright Canadian BC issue in his intial filing. The first filing seemed a bit streached to me and I thought, at the time, it was just a ploy to delay the Dem Convention. Then I became more interested and found it very odd that the Birth Certificate issue was not quickly solved by Obama. You don't hide documents unless you really have something to hide. His not addressing this issue when he easily could have, if he had the "vault" copy, sent my radar beeping.
I'm just waiting to see what the Judge will do. I think it is interesting that he didn't dismiss the suit yet, I feel that is very incouraging for Mr. Berg. Then the filing today by the DNC/Obama seemed odd to me as well.
Guess we will see soon enough, just not soon enough for me!

If he is delaying this until after the election is over there is no way they will impeach him because Congress will be controlled by Democrats and they will not let this happen. Phil, Thank you is just not enough to show you how much my husband and I appreciate all your hard work and long hours. Boy, the more I research and the more I see on youtube.com, the more I am convinced Phil, with your lawsuit, you are right on the money! I don't think that Hillary can be brought in at this point. I think the Dem VP Nominee is the only person who can step into the Election for the Dems right now. They could name a new VP -- Hillary -- but they can't replace the Presidential Nominee with anyone other than the Vice Presidential Nominee.
Additionally, I have long refused to believe that it could go this far, and yet it has. Up until now I have just thought that the reason why Obama has refused to release the Vault copy of his Birth Certificate is because it lists his religion as Muslim and he doesn't want that to be seen. However, I now think it's more likely that he doesn't have one to show. In other words, his stonewalling on this has now demonstrated to me that Obama is not a Native Born US Citizen. His lies have caught up with him and he thinks he can buffalo his way through this and get himself elected and then that will be it. Not so ... if he gets elected and sworn in and all of this comes out, we will be in a Constitutional Crisis and Biden will have to step up to the Presidency. Yikes!!!!!!!!!

It is time for someone to step up, this judge must do the right thing by the American people. What more is it going to take to bring this whole corrupt business to a close? There is simply no way that this man can get into the White House, we as American citizens must to all we can to prevent it, if the courts do not.

I doubt the court will act on behalf of P Berg. This close to elections it will likely sidestep the responsibility and cause a delay while the case moves up. This judge should be held accountable for not rendering an immediate ruling for discovery given the gravity of the cases outcome should discovery not solve the question the entire nation requires answered. Had the judge simply dismissed Bergs filing months ago I might believe there was no motive to block a timely litigation.

The case wasn't even filed until 8/21/08. Today is 10/8/08. Total time since initial filing is approximately one and a half months.
Back off and let the judge do his job the way it's supposed to be done.

If you haven't already heard Jerome Corsi and Tim Bueler are OUT of Kenya! I got the message last night right at the end of the Debate.
They were taken to the Airport by Guards with Automatic Weapons and when they were put on the plane they were told "Don't ever come back! See you in Hell"!
They were not even allowed to go back to their Hotel to pack and get their Luggage, it was delivered to them at the Airport. The TRUTH of what happened to them is on http://wnd.com. Joseph posted the Dispatch from Jerome as soon as he was released to get on the plane, detailing what happened from right before they were picked up to the time of their departure!
Thank any and all that Prayed for their SAFE return. It is evident that they uncovered something and possibly even got documentation that would help sink Obama, for this to happen to them. The problem is that whatever they had is gone now, as I'm sure who ever went to their room searched it throughly and all paper work was destroyed and not given to them!
Now I am asking that you all PRAY for this Law Suit to be ruled in our Favor, that the Court order Obama to turn over the Documents requested to prove whether he is eligible to be President. Otherwise we stand the chance of not only having a LIAR and a CROOK for our President, but an Illegal Alien also!!!

A birth certificate is applied for to the state that the child was born in. Parents are given a certificate of live birth when they leave the hospital. The parent must send a form to the state and a month or so later they receive an original birth certificate in the mail.

Assuming Obama was born in US and assuming his stepfather adopted him officially thereby making him a "natural citizen" of Indonesia, and assuming his mother didn't fill out the necessary state dept. papers upon sending him back to US, since Obama was not "of age", or 18 or older, he cannot be held responsibility for his "agent's" (parents) actions. Doesn't matter if he can produce a birth certificate or not. According to the Hawaii Revised Statutes, if he was born outside of the country, he can apply for a birth certificate. So what has to be looked into, is if he ( or his mother ) applied for a certificate this way. The certificate would show he was "born" in Hawaii, when he actually wasn't. (He did make a visit to Hawaii a couple of months ago )

Of course the "vault" copy of the cert. would show the hospital where he was born. However, the COLB ( which he released ) does not show that. So he could have one issued by the state in this way and the COLB would not reflect that.

It is interesting...when I tried to get a copy on the internet of the Star Bulletin article from Feb 18, 2008 in which Barack Obama's half sister (Maya) stated that Barack was born in Kenya it was blocked and I could not pull it up to read it. if the child was born abroad, the hawaian "vault" cetificate does not exist at all.
I dont think that Hawai accept a inscription without a genuine certificate coming from the country of birth.
That is why we cannot see this vault certificate : either it does not exist or it states an foreign place of birth.

Karen, FYI, the Star Bulletin, Feb. 18, 2008 article is attached to Berg's Opposition to Motion to Dismiss.
However, it says that Obama was born at Kapiolani Medical Center for Women, not Kenya. (This conflicts with the Rainbow Edition article also attached to Berg's Opposition, which states that Obama was born at Queen's Medical Center.)

If a parent applied for a Hawaiin birth certificate for an out of state birth, both the "vault" certificater and any COLB printed from it would show that out of state place of birth.
It would not show a place of birth of "Honollul" if in fact the baby was born in Mauntuak, or Montreal or Mombasa.

because the way his citizenship was listed at the school does not make even a prima facie proof of his citizenship at the time. I haven't read all to see what else I would change in the interests of truth, fairness, and proper legal pleading. I am no Obama partisan-- I think he is at best an empty suit and at worst a stealth Marxist. And clearly he is hiding something about his birth certificate, as Bill Clinton did re his medical records. But if Obama's mother was booked on a flight to return home to America, had her ticket, and was prevented from boarding due to her gravid condition, it is hypertechnical for his citizenship to turn on this fact. Moreover, if she was an American citizen, he is a natural born citizen no matter where he was born. Berg has his work cut out for him proving that she ever relinquished her U.S. citizenship. I will watch with interest to see how this plays out, but skepticism is the order of the day. If there is anything to this, the RNC should have been on it four years ago.

To those who must write such ignorant things, what is your issue with wanting to uphold what the United States stands for? If your Canidate Sen Obama, is such a stand up citizen, then my question is simply why doesnt he just give the documents being requested? If he loves our country and wants to preserve our constitution, and he is a natural born citizen, wouldnt he want to prove it? McCain was forced to show the proper documentation and he did. I am dumbfounded that this is such an issue for Sen Obama and the DNC. Hand the paperwork over and be done with it, if its not true then.

God,!, there so many things I do not agree with Obama the main one is his socialist agenda , the way he has acted all his public life, not the way he likes to picture himself in the center of the political spectrum. Has the court really denied obamas request for stay of discovery, and really ordered obama and the dnc to provide the documents by october 15th? Say it IS so Joe! someone please confirm or deny this so I can finally cut down on my nerve medication. I have been on pins and needles ever since I learned of this lawsuit, hoping and praying that this is the October Surprise that obama promised us. When I read those documents and saw the order from the court, I did cartwheels across the parking lot at work. Please someone tell me that it is so! For me this is the hope that the obama campaign keeps reciting.

I received a link that claimed that the judge ordered (on 9/29) Obama to submit his proof of citizenship. However, it was written by Berg himself. No judge signed it! In fact that whole document is not signed.
While I believe that Obama MUST prove his status and eligibility, we all need to be rational at this time no matter how difficult it may be. I am not happy about this situation, but we cannot allow ourselves to make false accusations and judge Obama "ineligible to run for President." That's the court's role in all of this. I only want Obama to defend himself as McCain did. I do not believe that ANY candidate has a right to ignore this issue or this requirement. This is an extremely sensitive issue and the consequences could be devastating if we allow our tempers to flare. For all we know this could be just another device of our devious politicians to create a state of crisis and turmoil. But I will say it again, I believe that Obama MUST prove his status and eligibility!!! I don't see what he has to gain by stalling this process.

My husband & I live in Cleveland and a friend in Toledo saw the Fox news piece and called us she said the coffee shops are buzzing about it. I can't believe we didn't know about this!! Has anyone taken two minutes to examine the B.C. Obama presented. My wife works in a Human Resource Dept. and said that this presumed B.C. would not be accepted as an legal document of birth - even for a dishwasher position:
1. No raised official seal.
2. No Official Certification signature.
3. The purple date stamp of NOV 6 2007 that bled through from the reverse side would not have shown through on bonded paper. This attempt at providing an official document would make an amateur forger embarrassed.

If possible, subpoena both hospitals' records by his name and date of birth, and his mother's name and date of birth.
If the registration of birth is signed by the doctor who delivered him, try to locate
the doctor through the state medical licensing agency.

Hmmm, puzzling. The on-line public records of birth, death, census and divorce for Hawaii only identifies Maya K Soetoro, but no Hawaii records for Barack Obama, Stanley Ann Dunham, Stanley A Obama, Stanley A Soetoro, Ann Dunham, Ann Soetoro.
The only Barack Obama records are addresses in Chicago, Ill.
Nationwide there are no public records for any Soetoros except Maya in HI.

I called the DNC this morning, asked for Howard Dean's office and spoke to his assistant. I asked her WHY they don't just go to the courthouse and cough up the document. She said they were waiting for the judge to rule. I said AGAIN...but if he's ELIGIBLE then why go through all this NONSENSE...just go down there and show it. She hemmed and hawed and finally just said "I'll pass along your comments to the Chairman." Now, if this doesn't REEK of cover up and having something to hide. I mean I will NEVER believe he is eligible, no matter how many phony documents they produce. I can just see Howie Dean in the basement of the DNC offices trying to put together some FORGERY of an American BC. ROFLMAO. But, yet again, I got a bunch of BS from the Dems. The link you posted says Obama's BAR status is "Voluntarily inactive and not authorized to practice law". He can't practice law in IL, because he decided to go inactive. Not because he didn't have malpractice insurance.
A lot of Illinois lawyers go Voluntarily inactive to avoid sanctions by the BAR. That could, or could not, be the case with Obama.

Look folks the simple matter is that when you run for office you show your proof to be eligible to a legal entity (Federal Election Committee), US Attorney General, or Court. You don't prove anything by saying you were born in Hawaii, or posting a short form version of a birth certificate on a website. That's not proof. A legal entity must review the actual docs. McCain released his actual docs to the FEC.

I've a question: if this case drags on, and takes months to settle - and assuming, Obama is actually elected President, and only then, we finally discover he is not eligible to serve as President - what then?

There's no seal or signature on the birth certificate on the fight the smears website. I can make that up in photoshop any day of the week. You could pay someone a $100 and they'd probably drop it into a file in the county clerk's office.

My wife and I have filed official complaints with the FBI and the Secret Service on this issue. We want action before the election on 4 November. I keep seeing several of you arguing over if these two documents are the same. I even read that one of you tried to state they are different stating that a certificate of live birth is given at the hospital......this is absolutely false.
I have five children, two were born in Maryland, and the other three born in Minnesota......the three born in Minnesota...we received paperwork at the hospital to fill out and send in for officale birth certificate copies....about a month later we received the certificate of live births for each of them respectively with the state seal and so forth.....this is proof positive to me that a certificate of live birth and a birth certificate are the same thing just different names....this is the exact piece of paper that had to be used to register my kids for school and the exact document that will be used to get drivers licenses when they are of age to drive so tell me if it is accepted by all these other agencies then why is it not proof enough to you..
That being said....I will admit, that a scanned copy on the internet is not proof positive but that is because a scanned copy will not show the water mark nor will it show the raised seal but the reality is that you can't expect Obama to send each and every american citizen a certified copy. That would be unreasonable.
The reality is that if there was any actual substance to this claim that Bush and his croonies along with McCain and Palin would already be all over this and would have brought this up months ago. The reality is that the Republicans have been trying to dig up as much dirt on Obama as they can for over a year now so to think that they would not have been able to come up with this before points to the fact that this is one person that is not happy with the fact that Obama (non-white person) might actually win a national election. The reality is that if Obama's skin was lighter then we would not be having this discussion at all.
I only ask all of you to be honest with yourselves...is that last statement true....you don't have to answer me just answer it for yourself......WOULD YOU BE ASKING THESE SAME QUESTIONS IF BARACK OBAMA WERE WHITE?
I am not saying that this is about race but the reality is that most of you honestly would have to answer that question with a resounding NO!
Well that is all. I am not here to talk down to anyone or to be talked down to by any of you. I see many of you trying to make this personal when in fact it shouldn't be....at least not to the level some of you are trying to make it.
One last point....how many times has President Bush refused to release records when it involves him and his integrity...One could use the same argument there as well....if he has nothing to hide why not just show the records......I suspect that many of you will see that differently though because you are obviously Bush and Republican supporters and that is fine....those of you that are Independant like myself will probably appreciate this more than anyone.
If you really want to fix all of this then why not get rid of the party labels and let individual persons run on their own personal merit. If you really want to stand up for the constitution then go and vote under the Constitution Party label and not Republican or Democrat.

A COLB is not the same as the actual birth certificate. Given the weird birth circumstances (2 hospitals in HI), Indonesian citizenship, and birth in Kenya stuff that is swirling around the Internet, you honestly have to say that something smells. I'm a retired career officer that served in military Combined/Joint Special Operations. I served with and worked for other officers, four star generals and below, that were the first blacks, Asians and Hispanics in their respective pay grades or specialities. Race of the candidates has absolutely NOTHING to do with my opinions or actions in this debate.
What is THE most important issue in this debate, to me, is Mr. Obama can NOT pass the lowest level security clearance investigation that a new recruit would be required to pass. You would expect me to consider such a candidate for Commander in Chief? You would expect me to trust such a candidate with our nation's most classified information? You would exspect me to vote for such a person with the personal history and lack of official documentation that he has?
You sir, seem quite sanctimonious and naive in your claims and seem to have a lack of understanding of the dire circumstances surrounding Mr. Obama's candidacy.
President Bush and Senator McCain were both fighter pilots before they entered politics. They both passed security investigations, held security clearances and provided full disclosure of their personal histories with all requested documentation. Barrack Hussein Obama has not been willing to do the same.
The American voter is due that kind of courtesy from him if he expects us to trust him, vote for him and then follow his leadership!

What is THE most important issue in this debate, to me, is Mr. Obama can NOT pass the lowest level security clearance investigation that a new recruit would be required to pass. You would expect me to consider such a candidate for Commander in Chief? You would expect me to trust such a candidate with our nation's most classified information? You would exspect me to vote for such a person with the personal history and lack of official documentation that he has?
You sir, seem quite sanctimonious and naive in your claims and seem to have a lack of understanding of the dire circumstances surrounding Mr. Obama's candidacy.
President Bush and Senator McCain were both fighter pilots before they entered politics. They both passed security investigations, held security clearances and provided full disclosure of their personal histories with all requested documentation. Barrack Hussein Obama has not been willing to do the same.
The American voter is due that kind of courtesy from him if he expects us to trust him, vote for him and then follow his leadership!

hey Chris,
Just to let you know, some of us are under the Constitution party and still want to know answers to many questions about Obama. I would agree with the fact that others have records that are locked. Many of those records are not of their lives previous to becoming president and that is of grave concern to me.
I along with many others would like to see those records that have been locked. You right also about not having to show his COLB to every American. He simply need to show it in court the same as MCain did when he was challenged.
This man (Obama) is hiding alot of information about himself and that is unsettling with many Americans and we should not have to worry about a split allegiance within our president before he would be in office.
If he is as innocent as you and some others would like me to believe then why doesnt he simply send the COLB to court and get it over with? You would think he would want those extra votes wouldnt you?

Personally, I have a great deal of respect for what this man has accomplished, and I have no content for hard working Americans either, since I come from a family of hard working Americans! Thank you Sam , while I may not be voting for Sen Obama, I am a registered Democrat. And only wish for this to be settled for the best interest of our country and our consititution!! And since Sen McCain also had to prove his citizenship and did, its only appropriate that Sen Obama come forth along with the DNC and do the same. It really should not be a huge ordeal, if the man is a natural born citizen legally.

If the judge doesn't make a decision soon then we the people should go and protest outside of the courthouse. This will give attention and put pressure on the judge to decide. If you think this will be a good idea let me know so we can decide what to do next.

DO NOT protest outside the court house. It won't do any good, and it could very well hurt Mr. Berg's case. The judge has to rule according to applicable law, not public opinion, protests, demonstrations, etc.

I believe I was the only one in the court room when this case went to the first hearing. So...with that being said the judge is unimpressed with having to decide either way. Remember all District judges are put on the bench by congress and this judge is no different. Relax it will come to pass and hopefully it will be in our favor.

The news today is that Obama raised another $150 million in September. His total collection according to the WSJ is $600 million, $175,000,000 more than what was put in the October 6th amended complaint. Seems like a whole lot of money for someone who claims to not be taking any money in from any lobbying group.
I wonder if the Judge will do what is right. I also wonder if no answer to the suit comes before the election if Mr Berg will vote for the Democrat on the ticket.

All federal judges (district courts, circuit appeals courts, and even the Supreme Court) are not put on the bench by congress. They are all appointed by the president and confirmed by the senate. Check the constitution.

OK, some of you have stated that McCain was asked to prove the same thing in court. I would ask that you show me where that record is because court records like that should have been made public.....If anyone can point me in the direction to see that then I will drop my charge of asking if people would have the same problem if this were asked of McCain.......
As for those of you who say you are in the military or formerly were in the military yet have a problem. Do you not trust a retired General of the military? I mean if a retired General like General Colin Powell (who by the way I have no love for due to his role in us going into Iraq to begin with) supports Obama and feels that Obama is the better person for the job then why are others still having issues.
I am not saying that you need to support Obama...that is not it at all but rather that we don't just say that he is not worthy because you may not agree with him on some fundamental issues.
As for Obama's fund raising...to say that his funds are coming from over seas is a stretch....is it that hard to believe that someone can not raise as mutch as he has if not for that.....lets think about this for a moment....the US population is over 300,000,000 with most of those being 18 and older so in reality it is not hard to see how one can raise that much money. If I remember correctly, the article I read said he now had approximately a total of 3,000,000 contributors which is less then 1% of the total US population so it would not be hard for that to be realistic.
As for hiding secrets.....I agree, that if he is hiding something it needs to be found out but with that same conviction I would ask each of you to go after all other polititians that are hiding things, both Republican and Democrat. Go after Bush and the things he has hidden because I don't care if it is something you hide before you get into office or after you get into office. As a public servant you have no right to hide information from the American Public that they claim to be representing. Make them all come forward honestly or don't cry about one that wont. Lets press the rules across the board equally or not at all.
I am so tired of seeing how everyone seems to want to have their cake and eat it too. They want to enforce rules on one but are unwilling to submit to those same rules themselves.

You all are right....if Obama is hiding something it needs to be found out but lets be fair. Do we believe in the constitution? If you say yes then that means you believe that a person is innocent until proven guilty and the burden of proof is always on the state to prove guilt. This also means that Obama does not have a legal obligation to prove anything. The state or the country has a right to try and prove him wrong but he is not required to prove he is right. Think about that honestly and you will see that I am right about that. Just because someone is arrested for a crime does not mean they are guilty. It must be proven against them. That is one of the fundamental rights under our wonderful constitution. None of us are guilty until proven guilty. None of us are guilty by association. We are all innocent until someone can prove we are guilty of something. That is the constitutional freedom that our military claims to be fighting for so...is that what they are fighting for or not. If not, then condemn Obama without providing verifiable proof but if that is what our military fights to protect then you should fight to protect it also and require that Berg prove his case in a court of law. I have read what Berg has put forth so far...I have not seen the evidence so from what I have seen there is nothing that is solid proof to me that Obama did not have citizenship from birth or that he gave up his citizenship at any time in his life. I don't want to hear speculation because anyone can speculate. I want to see the cold hard facts that prove he is not a citizen. Otherwise it is just assumptions that are unsupported.
As for the certificate of live birth versus a birth certificate. Again someone is trying to say they are different. I only have one thing to say in response to that......based on what writer Jim said then that means that the certificates of live births that I have for my three children born in Minnesota (which by the way do have the doctor's signature on them) are not legitimate and are not legal documents. Please explain to me how that is possible. You state you want something with the doctor's signature but you will not accept a certificate of live birth yet that is what I have on my three youngest born here in Minnesota and they were signed by the doctor. (OK based on that then my three youngest have no proof that they are natural born citizens because they don't meet your qualifications for that) Yeah Right!!!! I was there at their births and know for a fact they were born in Minnesota. They are also on the Minnesota birth index but again not all states publish their birth indexes and well a birth index is not a birth certificate (long form as you say) with doctor signature so again my kids are apparently not natural born citizens. We to you I say you might want to check into that more thoroughly because I know that my children were born here and I was born a US citizen so either your information as to what makes proof is wrong or we are not citizens and only those born in states that give something different are legitimate citizens.

It's very simple. If you are applying for POTUS then it is up to Obama to prove he is a natural born citizen. I'll give you an example. I want to apply for a job. Job requires I have a license. Therefore, I can't have the job unless I present it.

If an electrician does work in my house and does not have a license, and something wrong happens with the eletrical hookup and my house burns down, the electrician had perpetrated fraud becasue he is not who he says he is.
